Trump’s efforts to overturn the election are clumsy and petulant – but it’s still treason: historian

We are now witnesses to the most dangerous act of selfishness from the King of the Self. Trump knows the evidence for any form of election fraud is silly fantasy. His electoral deficits are beyond challenge–74 Electoral College votes and more than 5 million popular votes. Yet he repeats his denunciations of American elections, the bedrock of any democracy, that began when he was only a candidate. In October 2016, he called the election “one big, ugly lie”.

His disastrous character flaws are obvious to everyone. We, and here I mean all those who care about the real world around us, must now go beyond psychological analysis to political clarity. Trump is a traitor.

That most despised word is not necessarily synonymous with committing treason as defined in law. In the midst of a war against a foreign oppressor, our founders explicitly limited treason in Article III: “Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.” For centuries, our judicial system has hewed to that original language, standing on “only”.

The label traitor was used in a wider sense by Joseph McCarthy and the legions of supporters for his conspiracy theories. He asserted in 1954 that Democrats were the “party of treason” and the entire administrations of FDR and Harry Truman were guilty of “twenty years of treason”. The foreign enemy was obvious then, even without a declaration of war. Although many Democrats supported the anti-communist witch hunts associated with McCarthy’s name, Republicans have been using accusations of communism, and thus collaboration with the enemy, in elections ever since. John Stormer’s 1964 book “None Dare Call It Treason”, asserting that America had been thoroughly infiltrated by Communists, played an important role in Barry Goldwater’s presidential campaign and in influencing Ronald Reagan’s political philosophy.

Some of Trump’s foreign acts have skirted the line to treason, and I expect we will eventually learn more about details of his relationship with Russia that do involve giving aid to an enemy of America. But Trump has been the only President to routinely accuse the other major political party, which represents the majority of voting Americans, of being traitors, even for such petty offenses as not applauding his State of the Union address in 2018.

To properly judge Trump’s current behavior, we must think about treason inclusively. A useful conception of treason should include attempts to overthrow our constitutional system from within. Pinochet, the junta in Argentina, Mussolini, and Hitler all conspired to overthrow their own democratic governments. They were traitors to their fundamental laws.

Trump embarked months ago on an attempt to bring down the American republic during this election. Claiming that the 2016 vote that put him in the White House was rigged was typical of his unscrupulous boorishness and political egotism, but in a different category than asserting that the Democrats were from the beginning plotting to steal this election and are now doing that in front of our eyes. If there was any truth to this accusation, Democrats would be committing treason. But there isn’t, and that is abundantly clear to all but those Americans who believe every word of the President.

I might consider taking up arms against any group who was trying to take over my country, and I don’t even own arms. It is not surprising that Trump believers have brought weapons to intimidate elected officials, have plotted to kill Democratic Party leaders, and are now threatening revolt. Trump is purposely destroying the faith of millions of Americans in the legitimacy of their system of government. Afterwards he plans to return to his golden existence. But those supporters are making themselves outcasts in America, armed, angry, and woefully misinformed.

Commentators have searched for the proper words to label Trump’s current actions. Thomas B. Edsall asked many election experts about Trump’s behavior, and their responses include the words narcissism, sociopathy, dangerous, irrationalism, delusion, and norm-busting. The political scientist Bryan Garsten wrote in a New York Times opinion piece (November 9) that we should label Trump a “demagogue” as a way to protect our country from the next one. Sean Wilentz, professor of history at Princeton, was more politically pointed: if Trump rejected these election results, “it would be an act of disloyalty unsurpassed in American history except by the southern secession in 1860-61, the ultimate example of Americans refusing to respect the outcome of a presidential election.”

Margaret Sullivan wondered in a Washington Post column on Nov. 12 how journalists should “navigate this tricky path”: “How do you cover something that, at worst, lays the groundwork for a coup attempt and, at best, represents a brazen lie that could be deeply damaging to American democracy?”

It matters what words we use to label Trump. If the combination of Republican voter suppression and Republican rejection of election results is not called out for what it is, Trump will not just be busting norms, but destroying our still imperfect union. The proper label for that crime is treason.

Bank robbers who sign their hold-up notes may be incompetent, but they are still committing robbery. Just because Trump’s actions are clumsy, petulant, and unlikely to succeed, is no reason not to label their criminality properly.

And Trump is succeeding, at least in public relations. Seven in 10 Republicans now say the 2020 election was not free and fair: 48 percent of Republicans say it “definitely” was not free and fair, and another 22 percent say it “probably” was not. That’s twice the share of Republicans just before the election who said the race would not be free and fair. Before November, 68 percent of GOP voters said they had some trust in our elections. Now that has dropped to 34 percent.

The greatest security risk we face is not an external enemy. Only one-third of Republicans believe in American democracy. More than one-third think it is likely that the results we have heard will be overturned.

Trump’s tweet two days after the election, “STOP THE COUNT!”, has been widely misunderstood. Election officials do not heed his tweeted instructions. He was urging his supporters to stop those officials from counting ballots. That was incitement to insurrection.

Bringing a prosecution against Trump for treason would be futile and counter-productive. The flag-hugger’s treason is less a legal matter than a rhetorical issue. The recent willingness of news networks to label Trump’s lies as lies may not have swayed many of his supporters, but it has brought clarity to our thinking. Calling his efforts to overturn this election “treason” clarifies the significance of Trump’s anti-American actions.

Having a traitor in the White House was the fantasy of the TV thriller “Designated Survivor”. Now life imitates bad art.

In his first interview since losing to President-elect Joe Biden, President Donald Trump repeated false claims about voter fraud and suggested that the FBI was “involved” in stealing the election.

Trump made the claims while speaking to Fox News host Maria Bartiromo.

“They send millions and millions and millions of mail-in ballots,” Trump opined. “I’m sure you know people that got two, three, four — because I do. They got four ballots. They got one at a country home. Dead people were seeing ballots. But even worse, dead people were applying to get a ballot. They were making applications to get ballots. Many. And we’re not talking about 10 people, we’re talking — there are a lot of dead people that so-called voted this election.”

“This is total fraud,” he continued. “And how the FBI and Department of Justice — I don’t know, maybe they’re involved. But how people are allowed to get away with this stuff is unbelievable. This election was rigged. This election was a total fraud.”

Trump also suggested that the judicial system had been rigged against him.

“We go to judges and people don’t want to get involved,” Trump remarked to Bartiromo. “The media doesn’t even want to cover it. I mean, you’re doing something. You’re actually very brave.”

President Donald Trump and his legal crew of misfit attorneys have waged 39 lawsuits to overturn the 2020 election. All but one of them has been laughed out of court. Trump and his attorney, Rudy Giuliani, have continued going to court in an attempt to get a legal challenge to the U.S. Supreme Court. Trump also fired his cybersecurity czar responsible for securing the election after refusing to corroborate the story that the election was stolen.

In an interview with “60 Minutes,” Chris Krebs, former director of the Cybersecurity and Infrastructure Security Agency, explained that Giuliani and Trump are apparently attempting “to undermine confidence in the election, to confuse people, to scare people.”

“We can go on and on with all the farcical claims alleging interference in the 2020 election, but the proof is in the ballots. The recounts are consistent with the initial count,” Krebs told “60 Minutes” host Scott Pelley. “The American people should have 100% confidence in their vote.

He went on to lament that what Trump and Giuliani are doing to sow further division in the country is “a travesty” because the result has been all these death threats to election officials, to secretaries of state.”

“They’re defending democracy,” Krebs said of the election officials.

JUST IN: Arizona Certifies Biden’s 2020 Win in the Middle of Team Trump’s State Election Hearing

President Donald Trump’s team is in Arizona to continue his legal battle against the 2020 election results, though it appears all for naught since the state has now certified the victories of President-elect Joe Biden and Senate candidate Mark Kelly.

Arizona was one of several battleground states that came into contention after switching from Trump to Biden, but on Monday, officials announced that Biden defeated Trump by more than 10,000 votes, so his victory will be certified along with Kelly’s. Governor Doug Ducey also issued a statement that “I will be signing official documentation today. That will be hand delivered to the Secretary of the United States Senate, so that Arizona’s newest senator can be sworn into office as swiftly as possible.”

The news comes as Rudy Giuliani and his Trump team legal colleagues continue their testimony before Arizona Republican officials. This has consisted of Team Trump advancing the president’s evidence-free mass voter fraud claims and conspiracy theories, though Giuliani reportedly asked officials to override the certification in response to the development.

Wisconsin Completes Recount, Certifies Joe Biden’s Victory Over Trump

The state of Wisconsin certified its electoral results on Monday, ensuring that Joe Biden will carry the state’s 10 electoral votes. Biden won the Badger State by a margin of just over 20,000 votes, according to the certified results. President Trump had baselessly asserted that his campaign would overturn the results of the state, as well as those in other states he carried in 2016 that Biden carried this year. Arizona, another state that Trump won in 2016 that Biden flipped, certified its results earlier on Monday. ‘It’s over’: Joe Biden’s win is certified in all key states — and Donald Trump can’t handle it

Since Nov. 7, the result of the 2020 presidential race has been clear: Joe Biden has defeated President Donald Trump by a substantial enough margin that the outcome has never really been in doubt by serious observers. But on Monday, the results met a new official threshold as Arizona and Wisconsin became the final decisive swing states to certify their votes.

“All six key states have now certified their election results with Joe Biden as the winner,” said attorney Marc Elias, who has been involved in key election law cases for the Democratic Party. “Trump and his allies remain 1-39 in court.”

In addition to the newly certified swing states, Pennsylvania, Michigan, Nevada, and Georgia have also certified Biden as the winner. Georgia is still undergoing a recount, but it is not expected to affect the result, especially since the state has already conducted an audit of the ballots, carried out by hand, that affirmed a margin for Biden of more than 12,000 votes. Trump also funded recounts of two counties in Wisconsin, which likewise reaffirmed Biden’s win. Certifications are also being carried out in swing states Trump won and states where the presidential election outcome was never really in doubt.

Usually, the certification of the presidential results is not a newsworthy event, because — aside from the 2000 race, which was exceptionally close and disputed — the loser in the race concedes as soon as the media calls the election. That makes the formalities of the election process much less interesting to cover. This year, though, Trump has refused to concede the election and, in fact, continues to insist he won. He’s been pushing a slew of ridiculous and clumsy lawsuits, along with a disinformation campaign pushing conspiracy fictions, in an effort to overturn the election, but these baseless maneuvers have consistently failed to move him any closer to staying in power. The certification of the key results is just another sign that has clownish coup attempt is failing.

In theory, Trump still has some cards he could try to play. He could try to convince enough electors in the Electoral College to vote for him. But they won’t. Alternatively, he can try to convince legislatures in states he lost to send alternative slates of electors that really would vote for him rather than Biden. But there’s not really any mechanism to do this. Democrats in Congress would have the power to stop it. And the certification of the official results just makes any effort to overturn the vote all the more pathetic, duplicitous, and untenable. It’s just not going to work.

“We still have some mop up legal work to do, but it’s fair to say it’s over,” said Elias.

But Trump isn’t handling this news well. He’s been lashing out at his allies, like Republican Gov. Brian Kemp of Georgia, for failing to hand him victory, despite the fact that Kemp had no power or authority to do so. And Republicans seem increasingly worried that Trump is stoking animus among the party’s base for its elected officials, which could undermine their hopes of keeping the two Georgia Senate seats on the ballot in January runoff. If Democrats can win both those seats — which looks difficult but not impossible — they’ll take control of the Senate, giving Biden a much freer hand to enact his agenda.

That’s why it should be particularly concerning for Republicans that Trump is retweeting posts like the following, which express doubts about the purpose of voting for the GOP:

He lashed out specifically at Arizona Republican Gov. Doug Ducey on Monday because of his role in certifying the election results. To be clear, Trump has no grounds for objecting to the results in these states except for the fact that he lost.

This is likely doing serious damage to the GOP as a whole, spreading distrust between loyal party voters and the leadership, which has realized it can’t do anything about Trump’s loss. But much of GOP leadership, with a few key exceptions, spent far too long tolerating or supporting Trump’s empty talk of a stolen election; they may find it hard to turn the clock back now and convince their voters to accept an orderly return to electoral politics.

Tom Zawistowski, head of the Portage County, Ohio, Tea Party, took out a full-page ad in the Washington Times to promote his call for the president to “suspend the Constitution” to protect the Constitution.

“It is our exclusive right to elect our president and that sacred right has been infringed by the massive, planned, illegal election fraud conducted by corrupt Democrat/Socialist Party operatives across our nation to steal our vote,” wrote Zawistowski, who is also head of the right-wing We the People Convention that took out the ad.

Mike Flynn, recently pardoned by the president for lying to the FBI while serving as national security adviser, tweeted out a link to the We the People Convention — as did pro-Trump lawyers Lin Wood and Sidney Powell.

CNN refused to air any excerpts of Donald Trump’s 46-minute “propaganda video,” labeling the president’s rhetoric as merely a rehash of previous lies and baseless claims alleging widespread election fraud, of which there is no evidence.

On Wednesday afternoon, Trump posted a lengthy, rambling, conspiracy theory-laden speech to his Facebook account. During this rant, the president aired many, years-old grievances about the Mueller probe and repeated many false election fraud claims that have been debunked in the press or fallen apart during court hearings. Among those lies, that he “easily” defeated President-elect Joe Biden, when in fact he lost the popular vote by nearly seven million.

“A short while ago, the president released what is essentially a propaganda video on Facebook repeating some of the same lies he and his team have told about the election results,” CNN’s chief White House correspondent Jim Acosta said during the 6:00 p.m. edition of The Situation Room. “We are not showing you any excerpts because the allegations made by the president have been rejected in the courts as well as by state election officials from both parties, not to mention from his own attorney general and the video we should note was produced over here at the White House on the White House grounds, not in view of the press. Reporters were not in the room when the president made these comments.”

CNN host Erin Burnett also explained at the start of her show that she would not show any clips from Trump’s speech either, suggesting this was a network-wide position.

“Trump is also releasing a 46-minute video full of baseless claims about voter fraud,” Burnett noted, “which we are not going to air clips of because to do so would amplify things that are factually untrue, and the president knows to be factually untrue.”
