    Owen Shroyer, the former InfoWars commentator who recently made headlines for unfurling a "Trump won" banner at a Texas Rangers baseball game early this month, has been charged for partaking in the storming of the U.S. Capitol on Jan. 6, BuzzFeed News' Zoe Tillman reports.

    According to charging documents shared by Tillman, Shroyer was charged with Disorderly and Disruptive Conduct on United States Capitol Grounds and Obstructing and Impeding Passage on United States Capitol Grounds.

    The charging document states that Shroyer "traveled to Washington, D.C. in January 2021, and in advance of January 6, 2021, spoke of stopping the certification of the Electoral College vote."

    The complaint notes that Shroyer released a video on January 5 in which he declared that "Americans are ready to fight" and vowed to stop President Joe Biden from taking office.

    "We're not exactly sure what that's going to look like perhaps in a couple of weeks if we can't stop this certification of the fraudulent election," he wrote. "We are the new revolution! We are going to restore and we are going to save the republic!'"

    Shroyer also asserted that "everybody knows election was stolen . . . are we just going to sit here and become activists for 4 years or are going to actually do something about this . . . whatever that cause or course of cause may be?'"

    CNN’s Donie O’Sullivan spoke to a Donald Trump supporter who warned of a Taliban-like takeover in America if the former president isn’t restored to office.

    O’Sullivan appeared on New Day Monday to address the upcoming election audit from Maricopa County in Arizona. The audit’s credibility has been under tremendous scrutiny for some time, and O’Sullivan summed it up as a “sham” and “the biggest manifestation of the big lie about the election.”

    The CNN correspondent went on to introduce footage of several recent conversations with Trump supporters who firmly believe that the ex-president won the election and will be reinstated to office. There is no mechanism in the Constitution to make that happen.

    Stephen Palmer, one of the Trump supporters O’Sullivan spoke with at the Iowa State Fair in Des Monies, said “I don’t think there’s gonna be a 2024 election until we get the 2020 result.”

    “There’s no way at this point to overturn the 2020 election, right?” O’Sullivan asked.

    “There’s always a way,” Palmer replied — before referencing the Arizona audit.

    Then, Palmer darkly insinuated that America could go the same way as Afghanistan if that’s what it takes to return Trump to power.

    There’s millions of guns here. You know, it took 11 days for them to take over Afghanistan. Wonder how many days — just asking for a friend — how many days it would take the patriots to take over this country. Think about it.

    “You don’t want that to happen,” O’Sullivan responded.

    “I don’t want it to happen,” Palmer said, “but if our country, our government, our Congress and Biden don’t get their heads out of their butt, it’s going to happen. I assure you. It’s coming.”

    O’Sullivan’s segment is the latest of several interactions he has held with Trump supporters convinced that the former president’s reinstatement is inevitable. Some of these Trump supporters have threatened a new civil war if this doesn’t happen, and the nation has already seen the storming of the U.S. Capitol where Trump’s supporters — fueled by his election lies — disrupted Congress in a violent attempt to overthrow the 2020 election.

    On Monday, NBC4 Washington reporter Scott MacFarlane flagged a new filing by Pauline Bauer, an accused Capitol rioter who allegedly demanded House Speaker Nancy Pelosi (D-CA) be turned over to the crowd to be executed.

    Bauer, who represents herself and appears to be an adherent to the so-called "sovereign citizen" movement, has previously demanded the court "Drop all charges against my VESSEL" and quoted the Bible in her defense.

    Her latest filing is no less bizarre, according to MacFarlane.

    "I know you are new to this case but I retain my right to self determination," she wrote. "The court is aware of the Cestui Que Ve trust that I am Executor of and retain my rights to contract when I choose to under Admiralty Law. I challenge the courts [sic] jurisdiction and dominion over a living soul."

    She also demanded that the police turn over "a copy of your malfeasance and malpractice insurance so I may make a future tort claim" for arresting people "without due process of law."

    The "sovereign citizen" movement advocates the theory that people can act as their own government, and therefore are outside the jurisdiction of most of the laws laid out by the United States. To date, courts have not endorsed these ideas.

    Rep. Jim Jordan (R-OH) did more than any other Republican lawmaker to push Donald Trump's "big lie" about his election loss, and he was rewarded for his efforts by the twice-impeached one-term president, according to a new analysis.

    The Ohio Republican suggested as far back as Aug. 22, 2020, that Democrats would try to steal the election and used his frequent appearances on Fox News to push baseless conspiracy theories, and helped encourage the "Stop the Steal" rally that led to the Jan. 6 insurrection, and the Just Security website tracked those efforts in an extensive timeline.

    "This course of conduct arguably sets Rep. Jordan apart from every other Republican member of Congress who supported the Big Lie, voted to object to the certification of the election, or engaged in other related activities," the authors reported.

    Jordan was "the most prolific Fox guest" among GOP lawmakers, according to a Media Matters analysis, and also appears frequently on the right-wing Newsmax and OAN outlets, where he raised unfounded allegations of fraud that helped motivate extremists to storm the U.S. Capitol to overturn the election loss.

    "He also led efforts to create an image in the minds of Trump supporters of Jan. 6 as the 'ultimate date of significance' (his words, repeated several times)," the authors wrote. "He helped spearhead the effort to oppose certification of the election in Congress. He has continued to promote the 'Big Lie' even after the events on Jan. 6 and subsequent FBI and Department of Homeland Security (DHS) warnings that this conspiracy is propelling domestic violent extremists."

    Those efforts resulted in an award from Trump in the days following the insurrection.

    "On or before Jan. 4, President Donald Trump reportedly decided to award Rep. Jordan the Medal of Freedom," the authors wrote. "On Jan. 11, Jordan received his Medal of Freedom at the White House in a ceremony with no media present."

    according to a Statement From the selection committee, Representative Benny Thompson (D-Miss.), its chairman, has two weeks to provide companies with “records relating to the dissemination of misinformation, attempts to reverse the 2020 election, or to withhold certification.” Results, domestic violent extremism and foreign influence in the 2020 election.”

    The Democrat-majority House voted in late June to create the select committee, which was proposed by House Speaker Nancy Pelosi (D-Calif.) in mid-February.

    The committee consisted of seven Democrats and two anti-Trump Republicans, Rep. Adam Kissinger (R-Ill.) and Rep. Liz Cheney (R-Wy.)

    Pelosi previously dismissed two of the five Republican lawmakers nominated to the commission by House Minority Leader Kevin McCarthy (R-Calif.). In response, McCarthy said his disapproval represented “a serious abuse of power” and that Republicans “would not be parties to his fake process and would instead conduct our own investigation of the facts.”

    To hear his attorney tell it, accused rioter Kyle Fitzsimons was merely "caught up in the frenzy of the rally and protest" when Donald Trump incited his followers to storm the U.S. Capitol on January 6.

    It is a defense that first started getting noticed in the weeks following the insurrection. But even though Trump certainly incited the riot that day, it's not clear that it is a winning argument when it comes to the exoneration of the rioters.

    Fitzsimons, 37, of Lebanon ME, was bloodied by an officer's baton on the front lines of the riot, but "lowered his shoulder and charged at the line of officers" according to the FBI. The criminal complaint against him cited multiple witnesses who told agents of his "vocal right-wing beliefs," including frequent references to firearms.

    "Fitzsimons has been held without bail since Feb. 4, when authorities arrested him at his Lebanon home. He was indicted on 10 charges, including rushing at a line of officers, disorderly conduct and assault on a federal officer," the Bangor Daily News reported.

    "When a judge denied him bail in April, he rejected Fitzsimons' contention that a crowd pushed him from behind into a line of police at the Capitol.

    "'I saw you charge at the officers, you were beat down but then got up and went back at them,' U.S. Magistrate Judge G. Michael Harvey said at the time," the Daily News reported.

    In court Friday, however, Fitzsimons' public defender Natasha Taylor-Smith argued for his release pending trial "due to his "minimal" criminal history that includes a drunken driving offense and "no history of substance abuse or mental health issues." She said he is not a flight risk and poses no threat to the community," the newspaper reported.

    "Mr. Fitzsimons had no prior intent to enter the Capitol building or engage in violence, but the energy of the crowd that day is well-documented, and the mood shifted from one of purported patriotism to agitation," Taylor Smith said. She added that his mother has offered to open her Titusville, Florida, home to Fitzsimons, who worked as a freelance butcher in York County and has no passport.

    But the Portland Press-Herald reported this:


    "Federal prosecutors have a very different portrayal of Fitzsimons in their arguments to hold him in jail pending trial. Prosecutors had not yet responded Saturday to Taylor-Smith's latest request, but among the reasons they cited in earlier filings were threatening calls Fitzsimons allegedly made to the office of a member of Congress later identified as Maine's Rep. Chellie Pingree, D-District 1.

    "He was reported to be very aggressive, shouting and yelling," prosecutors wrote in a motion filed with the courts in March. "Fitzsimons said that he was going to 'give it to her hard' and that 'we're coming for her' (referring to the Congressperson)."

    "Fitzsimons allegedly called back the next day to say the Electoral College vote is "corrupt and total garbage. 'He urged the Congressperson to dispute the election results in January,' prosecutors wrote. "He stated that Biden is a corrupt skeleton and that this is going to be civil war." In another call, Fitzsimons identified himself as 'Kyle Fitzsimons, the man who wants to start a war' as he demanded a number for Chinese President Xi Jinping."

    The most serious felony crimes charged in connection with the Capitol riots have stiff maximum penalties. Obstruction of an official proceeding — a crime that more than 200 people have been charged with — carries up to 20 years in prison. Illegally entering the Capitol is a misdemeanor, but doing so while carrying a deadly or dangerous weapon — something more than 40 defendants are charged with, according to the Justice Department — carries up to 10 years in prison. Assaulting police officers can carry up to 8 years in prison, or up to 20 years if a weapon is involved.

    Of the roughly 465 defendants arrested in connection with the Jan. 6 riots so far, more than 200 are charged solely with misdemeanor offenses, such as illegally entering the Capitol, disorderly conduct, and protesting inside the building. Those crimes carry maximum sentences of between six months and one year in prison. Defendants whose presence at the Capitol was short-lived and nonviolent may make a case for no prison time if they plead guilty and have little to no prior criminal history; other penalties can include a fine or a period of supervised release.

    The most common felony charge facing the rest of the group is obstruction of an official proceeding. Hodgkins’ sentencing range suggests other defendants who plead guilty to obstruction but no other serious crimes are looking at far less time than the maximum. He has no previous convictions, and he’ll get credit for accepting responsibility and pleading guilty early. His agreement allows him to argue for a sentence below 15 months. He’s also agreed to pay $2,000 in restitution, his contribution toward what the government has estimated was $1.5 million in damage; the Washington Post reported prosecutors are extending plea offers that seek $2,000 in felony cases and $500 in misdemeanor cases.

    NBC investigative reporter Scott MacFarlane is reporting that emails sent to Vice President Mike Pence and Donald Trump cabinet members from average Americans, urged them to take action against the now ex-president after he helped incite the Capitol riot.

    According to a tweet from McFarlane on Sunday, a FOIA request seeking internal emails from the former administration turned up pleas from the public to either use the 25th Amendment to remove Trump from power or impeach him once again.

    As McFarlane explained in his tweet that was accompanied by screenshots of the emails, "Freedom of Information Act, internal Trump Admin. emails show Donald Trump's Cabinet received requests from outraged citizens on January 7th... asking they invoke the 25th Amendment."

    One emailer, writing to Pence -- who resisted derailing the certification of the 2020 presidential vote despite pressure from Trump -- and pleaded, "When the Vice President and the entire Congress have to be HIDDEN in order to be safe from the actions of the President of the United States, it is time to permanently and completely remove the President from power.'

    That same writer added, "I urge you to immediately do everything to bring that about."

    Another writing to former Secretary of Energy Dan Brouillette on the day after the Jan. 6th riot, bluntly called it an "insurrection," before adding, "The January 6th attack that left four Americans dead was not a random event. President Trump has spent months inciting these events through his anti-democratic rhetoric and actions. Now is not the time for small steps and half-actions."

    Those calls for invoking the 25th Amendment did not come just via emails, with historian Michael Beschloss tweeting, "We are now witnessing a primal threat to our democracy. Constitutional remedies may include 25th Amendment and impeachment and removal of the President."

    Conservative columnist Jonah Golberg simply tweeted, "25th Amendment now," and former White House official Joe Lockhart chiming in, "The cabinet should convene and remove the President under the 25th amendment. We have a President who is now engineering a violent coup attempt."
