    Indictments against Oath Keepers co-founder Stewart Rhodes and 10 others serve as a reminder that the Jan. 6 insurrection could have been much worse.

    The right-wing paramilitary group attempted to make a coordinated move on the Senate chamber, according to the seditious conspiracy indictment, and "tried to push their way through" a line of police officers who "forcibly repelled their advance" -- and seemingly stopped them from executing their mission, reported CNN.

    Other rioters managed to get inside the Senate floor and gallery, but the Oath Keepers -- who prosecutors say had stockpiled firearms at a nearby hotel in Virginia for a "quick reaction force" -- were prevented by police from breaking through, and the new indictments dramatically raises the stakes of the plot to prevent Joe Biden from becoming president.

    Rhodes allegedly purchased a rifle, a magazine and other firearms equipment, including sights, mounts, triggers, slings and an optic plate, on his way to Washington, D.C., before Jan. 6, and prosecutors say he "directed" his supporters to go into the Capitol, where he was present on the grounds but did not go inside himself.



    The indictment alleges the Oath Keepers intended to stop the transfer of power from Donald Trump to Biden, and one defendant boasted the group was "reloading" after the insurrection failed, and Rhodes allegedly told associates to organize local militias to stop Biden from being inaugurated.

    The militia co-founder allegedly spent more than $17,500 on weapons, equipment and ammunition in the week after the riot, and one group member urged him to stay "below the radar" while another Oath Keeper brought what he called "all available weapons" to Rhodes' home in Texas.

    "Rhodes and certain co-conspirators ... planned to stop the lawful transfer of presidential power by January 20, 2021, which included multiple ways to deploy force," reads the indictment.

    Less than one week after the January 6 insurrection House Republican Minority Leader Kevin McCarthy was interviewed by a local California radio station and revealed that President Donald Trump admitted to bearing “some responsibility” for the violent and deadly attack on the U.S. Capitol.

    “I say he has responsibility,” McCarthy told KERN on January 12, 2021, as CNN’s K-FILE reports, calling it “a little-noticed local radio interview.”

    “He told me personally that he does have some responsibility,” McCarthy declared. “I think a lot of people do.”

    McCarthy in that interview also called for a bipartisan investigation, which he subsequently blocked, leading to the formation of the current Select Committee on the January 6 Attack.

    “Let me be clear to you and I have been very clear to the President. He bears responsibility for his words and actions. No if ands or buts,” McCarthy said on January 11, 2021. “I asked him personally today if he holds responsibility for what happened. If he feels bad about what happened. He told me he does have some responsibility for what happened. But he needs to acknowledge that.”

    I just hope that each and every cheerleading Republican is running freaking scared! They should be looking over their shoulders! These four guys are going to be key to restoring our democracy. Once they realize the level of corruption of the Republicans at the federal level, I hope they recognize that those at the state level are just as corrupt if not more!

    The saga of MAGA rioter Kenneth Kelly just keeps getting stranger.

    Kelly, 58, of Ocala, FL was sentenced today by a federal judge to 60 months home confinement, but he “currently lives in a recreation vehicle that he uses to commute between Florida and New Mexico, where he is working to provide medical services to under-served communities,” it was reported at the Fox 35 Orlando TV station.

    That will mean Kelly will be required to wear a GPS locator. But getting home confinement to an RV is just the latest oddity of Kelly’s odyssey.

    Last April, Kelly garnered minor fame as the MAGA rioter who thought he was breaking into the White House. He was described at the time as a “a QAnon-obsessed Trump supporter recently turned in by his family for storming the Capitol on January 6 (who) didn't even know the difference between the Capitol and the White House.”

    In the FBI complaint against him, Kelly was described as “wearing a dark-colored Trump beanie and dark-colored puffer jacket” and having had texted the following:

    “Inside White House via breaking in windows. Tree of liberty was watered today.”

    In today’s episode, there was this new information about Kelly: “According to court documents and testimony, Kelly lost his job with Advent Health as an emergency room doctor after he was arrested, he lost his marriage and custody of his children.” In addition to what was reported as his new pursuit of helping underserved communities, Kelly was described as contrite.

    “In court on Friday, Kelly expressed regret about the seven minutes he spent inside the Capitol.

    “I am a different man,” he told the court. “I blame myself for what I did that day. I take full responsibility.”

    Kelly had pleaded guilty to one count of parading at the Capitol in September. He was also sentenced to 12 months of probation.

    In a column for MSNBC, Harvard Law Professor Laurence Tribe and former federal prosecutor Dennis Aftergut make the case that the decision by the Justice Department to indict eleven members of the Oath Keepers for seditious conspiracy related to the Jan 6th attack on the Capitol should be a game-changer for anyone involved in the planning of activities that day.

    Getting right to the point, the two wrote, "We’ve reached a turning point on the road to accountability for those who led the Jan. 6 insurrection, whether they stormed the physical congressional barricades or not."

    As they note, just because someone didn't storm the Capitol building and cause lawmakers to flee for their lives, doesn't mean that they can't be indicted for sedition.

    Explaining, "That crime is, in effect, treason’s sibling. Under 18 USC §2384, seditious conspiracy is an attempt “'o overthrow, put down, or to destroy by force the Government of the United States, or... by force to prevent, hinder, or delay the execution of any law of the United States.' It is punishable by up to 20 years in prison," they added, "This historic indictment creates an enormous incentive for the defendants to cooperate with the government and help fulfill Attorney General Merrick Garland’s Jan. 5 commitment to hold 'all January 6th perpetrators, at any level, accountable under law — whether they were present that day or were otherwise criminally responsible for the assault on our democracy.' Four other Oath Keepers (at least) are already cooperating."


    According to the two legal scholars, sedition charges could be in store for some Republicans who attempted to overturn the 2020 presidential election results -- even at a distance.

    "As we have written elsewhere, the efforts by Republican politicians, lawyers and operatives to find corrupt but nonviolent ways to overturn the election results were 'Plan A.' Its failure required 'Plan B' — the Jan. 6 attack on the Capitol — as the fallback option to keep Trump in power," they wrote. "In recent days, multiple media outlets have added to the evidence of just such a Plan A by reporting on forged electoral slate certificatesalmost identically worded and formatted — purporting to name Trump electors in seven states that he lost. The fraudulent documents were actually submitted to the National Archives in December 2020, but without the support of state governors or secretaries of state, they were ignored."

    Adding, "It appears that some Republicans hatched that unsuccessful national plan so that Pence might recognize 'alternate slates' as a basis for disrupting or delaying the Jan. 6 certification. On Jan. 13, Michigan’s attorney general referred her state’s fake elector documents to the United States attorney, a referral likely bound soon for [Merrick] Garland’s desk," the applauded the work of the DOJ and wrote, "We continue to hope that the Justice Department will promptly and exhaustively investigate the pre-Jan. 6 coup attempt that came perilously close to ending America’s constitutional world — not with a bang but with a whimper"

    In his weekend wrap-up, conservative Bulwark founder Charlie Sykes makes the case that there is more than enough proof that Donald Trump and his inner circle made a provable attempt to steal the 2020 presidential election through fraud.

    Jumping right into it, Sykes pointed to a CNN report that stated, "...then-President Donald Trump's allies sent fake certificates to the National Archives declaring that Trump won seven states that he actually lost," which have also been labeled forgeries.

    According to the political analyst, "In other words, what we have here is attempted election fraud on a massive scale," adding, "Some perspective: If an average voter lied on their registration forms or forged an absentee ballot, they would face criminal charges and a world of legal hurt. But this case is far worse because the forged electoral certificates were coordinated, and part of a larger conspiracy to overturn the presidential election."

    Writing, "...the smoking guns are littered all around us," Sykes turned to Bulwark colleague Bill Kristol who tweeted on Saturday, "The forged electoral certificates show coordination across seven states. Those fake certificates were key to the plan of the Eastman memo and to the Jeffrey Clark DOJ draft letter to Georgia. The conspiracy involved fraud and force. At the head of the conspiracy: Donald Trump."



    That, in turn, elicited a response from conservative lawyer George Conway who chipped in, "Makes you wonder how there could have been a conspiracy or attempt by Trump or Eastman and others to 'corruptly ... obstruct[], influence[], or impede[]' the electoral-vote count proceedings within the meaning of 18 U.S.C. § 1512(c)(2)."

    Prosecutors should charge the 59 Republicans who submitted phony electoral college certificates as part of Donald Trump's efforts to overturn the 2020 presidential election, which was won by Joe Biden.

    "Those representations were lies," 40-year attorney Phlip Rotner wrote for The Bulwark.

    "Biden, not Trump, had won the elections in each of those states. In each of those states, Biden’s victory had been certified by the officials given clear statutory authority to do so," he wrrote. "In short, the individuals who signed the documents certifying that they were the 'duly elected and qualified' electors from their states were not. Their certificates were fraudulent, full stop. No doubt or ambiguity about it."

    In Arizona, eleven people signed the phony electoral college certificate. Sixteen signed it in both Georgia and Michigan. Six were submitted from Nevada and ten from Wisconsin.

    "The fraudulent scheme did not end with the signatures of the phony electors. Far from it. In each of the five states, the would-be electors transmitted the phony certificates to federal officials as their state’s 'electoral votes for President and Vice President.' Again, false," he explained. "It is astonishing that more than a year after the certification of the 2020 presidential election, public attention has only now begun to focus intensely on these phony GOP state certifications. They are not just deplorable political acts of subversion. They are criminal acts."



    Rotner explained how individual states should've held the GOP officials to account for the fraudulent documents.

    "State and federal law enforcement should have been all over this for almost a year now. Worse, even for those inclined to think 'better late than never,' it’s still not clear that they are on it now," he wrote. "Start with state law. As you can imagine, every state in the union has criminal laws prohibiting all forms of election fraud. For present purposes, one example will suffice: In Arizona, a person who knowingly forges or counterfeits returns of an election is guilty of a 'class 3 felony,' the minimum penalty for which is two and a half years in prison."

    Rotner noted that it appears the effort was coordinated, which could provide further legal jeopardy for those involved in the conspiracy.

    "These phony certifications were not isolated, one-off events. They were highly coordinated. A single glance at the five phony certificates shows that they are nearly identical in format and text, right down to the fonts.
    The strong implication: Somebody somewhere was running this show," he wrote. "The involvement of top Trump administration and campaign officials in this effort looks deep and wide. It’s the job of the January 6th House committee and (hopefully) the Department of Justice to put together all that information, and presumably journalists will continue to dig into it. But as of now, it sure looks like Mark Meadows, Trump’s chief of staff, was right in the middle of election-fraud effort."

    Rotner said the effort to impede the electoral count may have violated 18 U.S.C. § 1512(c)(2), 52 U.S.C. § 20511, 18 U.S.C. § 371, 18 U.S.C. § 1001, and 52 U.S.C. §10307.


    "f federal prosecutors are already investigating these crimes, they have done a bang-up job of keeping it secret. It has been a year since the phony certificates came to light, and the criminal case to be made is not complicated," he explained. "It’s not as if we don’t know the identity of the culprits—the signers of the fraudulent certificates are all identified on the face of the documents. The individuals who transmitted them to the federal government signed their names to the transmittal memoranda. It’s all right there, wrapped up in a nice, tidy package that can be cut and pasted straight into an indictment."

    'Alternate' Michigan elector claims he got marching orders from a Trump lawyer: report

    Speaking to MSNBC's Nicolle Wallace, Michigan Attorney General Dana Nessel cited a Detroit News report that said a fake elector admitted that he got his marching orders from former President Donald Trump's campaign.

    Republicans in Michigan, as well as other states, attempted to install an alternate slate of electors to replace the ones who would have followed the will of the public vote in the state. Nessel hasn't yet investigated or spoken to the fake elector, but she did turn over all of the evidence and information that her office found relating to the fake electors to the Justice Department.

    "It's an open and shut case," said Nessel, saying that they committed the crime in full view of the public.

    Wallace, along with commentator Charlie Sykes, noted that the documents were signed by the false electors and given to the government as official documents, which is fraud for all who signed the documents.



    The host also said that she couldn't help but notice that the forms, the fonts, each detail in the documents all looked exactly the same from each of the states where Trump electors attempted to overthrow the valid electors.

    Nessel said that it appears the principal actors transmitted the form to every state that they took issue with. Because of the multi-state nature of the crime, it was necessary to take everything to the DOJ.

    The Detroit News detailed how the fake electors were working with a Republican lawmaker with a Capitol office who could figure out a way to get them inside the elector room where the official count was taking place. The building was sealed off, however, after electors tried to barge in.

    "...(W)e convened and organized in the state Capitol, in the city of Lansing, Michigan, and at 2:00 p.m. Eastern Standard Time on the 14th day of December 2020," said a false certificate signed and submitted to the National Archives that MSNBC Rachel Maddow pointed to last week.

    Nessel said Monday that those fake electors should be prosecuted.

    Shelby Township Clerk Stan Grot told the Detroit News that he was asked to show up in Lansing to sign the document. He said he didn't know who called him and told him to do it, and claims it was merely "a call from an attorney working on behalf of Trump in Washington, D.C."
