    DHS Creates New Center for Prevention Programs and Partnerships and Additional Efforts to Comprehensively Combat Domestic Violent Extremism

    WASHINGTON – Building on the Biden-Harris Administration’s commitment to combating all forms of terrorism and targeted violence, Secretary of Homeland Security Alejandro N. Mayorkas announced today that DHS has established a new Center for Prevention Programs and Partnerships (CP3) to improve the Department’s ability to combat terrorism and targeted violence, consistent with privacy protections, civil rights and civil liberties, and other applicable laws.

    “CP3 will help build local prevention frameworks to provide communities with the tools they need to combat terrorism and targeted violence,” said Secretary Mayorkas. “Individuals who may be radicalizing, or have radicalized, to violence typically exhibit behaviors that are recognizable to many but are best understood by those closest to them, such as friends, family, and classmates.”

    CP3 will replace the Office for Targeted Violence and Terrorism Prevention while ensuring DHS’s efforts are grounded in an approach to violence prevention that leverages behavioral threat assessment and management tools, and addresses early-risk factors that can lead to radicalization to violence.

    Secretary Mayorkas also announced a new, dedicated domestic terrorism branch within the Department’s Office of Intelligence & Analysis (I&A) to ensure DHS develops the expertise necessary to produce the sound, timely intelligence needed to combat threats posed by domestic terrorism and targeted violence. I&A will also continue leveraging the National Network of Fusion Centers and our deployed intelligence professionals who collect and analyze threat information alongside our state, local, tribal, territorial, and private sector partners to increase timely and actionable information sharing in a dynamic threat environment.

    The creation of CP3 and the I&A Domestic Terrorism Branch are the latest actions DHS is taking under Secretary Mayorkas’s leadership to comprehensively combat domestic violent extremism, including violent white supremacy. Since January 20, 2021, DHS has increased the development, production, and sharing of intelligence and other actionable information central to countering domestic violent extremism, which now poses the most significant and immediate terrorism-related threat to the United States. On January 27, 2021, DHS issued a National Terrorism Advisory System (NTAS) Bulletin due to the heightened threat environment. It was the first NTAS issued in more than a year and also the first to focus solely on a domestic threat.  Further, in February, Secretary Mayorkas designated combating domestic violent extremism as a ‘National Priority Area’ for the first time in FEMA grant programs. As a result, state, local, tribal, and territorial governments are required to spend at least 7.5 percent, or a minimum of $77 million, of their DHS grant awards toward combating this threat. The Department is also increasing training opportunities for law enforcement partners, including through threat assessment and management programs related to domestic violent extremism.

    Secretary Mayorkas has directed DHS to embrace a whole-of-society approach to combating domestic violent extremism and all other forms of targeted violence and terrorism by building trust, partnerships, and collaboration across every level of government, the private sector, non-governmental organizations, and the diverse communities we serve. The federal government cannot do this alone – we must work together.

    The U.S. government is reportedly secretly issuing warrants for Google to provide user data on anyone typing in certain search terms, raising fears that innocent online users could get caught up in serious crime investigations at a greater frequency than previously thought.

    In an attempt to track down criminals, federal investigators have started using new "keyword warrants" and used them to ask Google to provide them information on anyone who searched a victim's name or their address during a particular year, an accidentally unsealed court document that Forbes found shows.

    Google has to respond to thousands of warrant orders each year, but the keyword warrants are a relatively new strategy used by the government and are controversial.

    “Trawling through Google’s search history database enables police to identify people merely based on what they might have been thinking about, for whatever reason, at some point in the past,” Jennifer Granick, surveillance and cybersecurity counsel at the American Civil Liberties Union, told Forbes.

    “This never-before-possible technique threatens First Amendment interests and will inevitably sweep up innocent people, especially if the keyword terms are not unique and the time frame not precise. To make matters worse, police are currently doing this in secret, which insulates the practice from public debate and regulation,” she added.

    The government said that the scope of the warrants is limited to avoid implicating innocent people who happen to search for certain terms, but it's not publicly disclosed how many users' data are sent to the government and what the extent of the warrant requests are.

    U.S. Justice Dept defends efforts to step up monitoring threats to school boards

    On Monday night, Attorney General Merrick Garland issued a new memo directing the FBI and federal prosecutors to meet with local and state police within 30 days to discuss strategies for addressing the "disturbing trend" of threats facing America's public educators.

    "While spirited debate about policy matters is protected under our Constitution, that protection does not extend to threats of violence or efforts to intimidate individuals based on their views," Garland wrote.

    The memo comes as school boards across the country, including in nearby Loudoun County, Virginia, have seen a rise in protests and violent rhetoric fueled by right-wing media over claims that public schools are indoctrinating children into thinking America is a racist country through the teaching of a doctrine known as critical race theory.

    Critics say there is no evidence to suggest that critical race theory is being taught in most, if any, public schools, but the topic has led to waves of protests and often raucous school board meetings.

    At the same time, schools have also been caught in the cross-hairs of an ongoing national debate over whether students should be required to wear masks to protect against the spread of the coronavirus.

    Republican Senator Josh Hawley blasted the memo on Tuesday, comparing it to the "McCarthy era," a reference to the controversial practices of Republican Senator Joseph McCarthy, who stoked Cold War era fears in the 1950s by alleging that Communists had infiltrated the U.S. government, military and film industry.

    "Is parents waiting, sometimes for hours, to speak at a local school board meeting to express concerns about critical race theory or the masking of their students... is that in and of itself harassment and intimidation?" he asked.


    "Spirited debate is welcome," Monaco said, adding that the memo makes it clear that the department is only focused on addressing situations that could turn violent.

    DOJ Announces New Office Focused on Environmental Justice

    The U.S. Department of Justice announced on Thursday that it is taking a “series of actions to secure environmental justice for all Americans.” Among the new initiatives is the formation of a new office that will enforce increased environmental regulations and help with combatting the “climate crisis”, according to U.S. Attorney General Merrick Garland.

    Since taking office, President Biden has launched the “Justice40” initiative, which aims to provide 40% of the benefits of government climate and clean energy investments to “historically disadvantaged communities.”

    On Thursday, Garland said the department will prioritize cases that create the greatest impact on communities “most overburdened by environmental harm.”

    “Although violations of our environmental laws can happen anywhere, communities of color, indigenous communities, and low-income communities often bear the brunt of the harm caused by environmental crime, pollution, and climate change,” Garland said.

    The new Office of Environmental Justice will “serve as the central hub for our efforts to advance our comprehensive environmental justice enforcement strategy,” the AG continued.

    Associate Attorney General Vanita Gupta issued a “comprehensive environmental justice enforcement strategy” to guide the department, as well as U.S. attorneys nationwide, on the new policies and standards.

    Garland tapped Cynthia Ferguson, who works in the Justice Department’s Environment and Natural Resources Division, to serve as executive director of the new office.

    Serious errors committed by the Census Bureau may end up impacting the 2024 election, experts warn.

    A Census Bureau study published in late May shows that Republican-leaning states were under-counted by statistically significant margins, while Democrat-leaning states were over-counted by statistically significant margins. The census, mandated every 10 years, was conducted during the pandemic.

    The Wall Street Journal Editorial Board highlighted the undercounting in a late May piece, writing, “Remember how Democrats accused the Trump administration of trying to rig the 2020 Census? Now a Census Bureau study reveals that Republican-leaning states may have been hurt by mistaken under-counts.”

    States that had large over-counts included Hawaii, Delaware, Rhode Island, Minnesota, New York, Utah, Massachusetts, and Ohio, the WSJ noted, and states that under-counted include Arkansas, Tennessee, Mississippi, Florida, Illinois, and Texas.

    In Florida, for example, two additional congressional seats were expected to be added following the 2020 census. The state only gained one, but if the census had been properly counted, it would have gained two.

    “Texas was under-counted by about 570,000 people while New York was over-counted by 695,000,” The Wall Street Journal noted, highlighting that “the inaccuracies may have cost Florida and Texas an additional House seat and given Rhode Island and Minnesota one they shouldn’t have received.”

    “New York might have also lost another House seat if the Census were more accurate,” the board continued. “So how did the bureau get the counts so wrong? The bureau blames the pandemic.”

    “Last week’s Census Bureau announcement of serious errors will impact the next decade’s congressional apportionment and delegations, and play a crucial role in the presidential race,” Tate said. “Given the nature of the mistakes, Democrats could hang onto the presidency under particularly controversial circumstances due to publicly-acknowledged errors.”

    Tate notes that accurately counting every person in a nation is “a logistical challenge, to be sure,” but noted: “it is difficult to understand how the Census Bureau missed more than 5 percent of the populations of Arkansas, Delaware and Hawaii.”

    The 2020 census resulted in “significant changes to congressional seats apportioned to states,” Tate said: North Carolina, Florida, Montana, Colorado, and Oregon each gained one congressional seat while Texas gained two, and New York, Pennsylvania, West Virginia, Ohio, Michigan, Illinois, and California all lost one seat each.

    “Simply put, the revised figures show that (mostly) red states had even quicker relative population growth compared to the rest of the country — and especially compared to (mostly) blue states,” she continued. “It is entirely possible that undercounted states could have gained at least one seat in Congress, while overcounted states may have lost at least one each.”

    Each lost or misplaced seat is “crucial,” Tate emphasized, pointing to the census bureau’s admission that it overcounted over 600,000 New Yorkers and undercounted almost as many in Texas.

    “Last year,” she wrote, “media coverage lamented that New York lost a member of Congress by being 89 residents short. With the revised, accurate numbers, New York may have lost a second seat — had the corrected numbers been available earlier.”
