    Rep. Matt Gaetz (R-Fla.) and Rep. Marjorie Taylor Greene (R-Ga.) are demanding a federal probe into suspected federal agents and far-left operatives inciting violence before and during the January 6 protest.

    In a joint press conference Thursday, the two Republicans said Ray Epps, an Arizona man who has mysteriously disappeared from the FBI’s most wanted list, called for a breach of the U.S. Capitol right before it happened, but hasn’t been charged.

    “Ray Epps was originally on the FBI’s list of most wanted individuals after the initial events on January 6, but then the day after Revolver News publishes an exclusive report about Stewart Rhodes, who’s involved with the Oath Keepers, then all of a sudden Ray Epps’ name falls off the list,” Gaetz explained. “We’ve sent letter asking questions about that unexplainable circumstance and the FBI and the Justice Department have given us no illuminating information.”

    Both lawmakers reiterated, alleging the federal government is behind the deadly events of January 6. The Republicans added, they have yet to hear a response back for Attorney General Merrick Garland and the FBI’s director surrounding the events leading up to January 6.

    Gaetz and Greene asserted that the federal government has a history of infiltrating patriotic groups and Ray Epps appears to be part of those efforts. Additionally, Greene took aim at the way mainstream media covered the events of January 6, including how it has portrayed the protestors.

    “I’m not one that’s going to just sit there and take and duck and, you know, hide under cover when the mainstream media and the Democrat Party wants to label people and tell lies,’ she stated. “We’re here because we want to get our in front and say we think there’s real questions that do need to be asked.”

    The congresswoman expressed her frustration by saying if Democrats really cared about riots and protests, they would have worked hard to put an end to the Antifa riots back in 2020, but instead contributed to the violence. She then indicated that not one Republican has helped incite violence like the Democrats have.

    Furthermore, the Republican lawmakers pointed out none of January 6 defendants have been charged with insurrection or terrorism. They also added, those detainees are subject to inhumane detention conditions in jail.

    Moving forward, the Georgia Republican emphasized a transparent and unbiased January 6 Committee is needed to give the American people the truth they deserve.

    On Tuesday, writing for The Crime Report, Boston defense lawyer James Doyle outlined his case for charging former President Donald Trump with seditious conspiracy for his efforts to overturn the 2020 presidential election.

    "Watching a riot on television is not a crime," wrote Doyle. "But the hours spent passively savoring that particular riot do provide compelling circumstantial evidence of Trump’s state of mind — of his goals and intentions — as he maneuvered throughout the period between Election Day and the riot to hold power ... From Trump’s inaction we can infer — the inference is inescapable — that he meant to see the certification of the electoral vote delayed and, if possible, prevented. After that, something might break his way. He might hold onto power."



    All of this, Doyle argued, meets the federal criteria for the crime of seditious conspiracy, which requires that "two or more persons ... conspire ... by force to prevent, hinder, or delay the execution of any law of the United States." None of this requires that Trump put his plan into action with hundreds of people — just that Trump and his "inner circle" agreed to something that intentionally led to the riot taking place.

    "For once, his conduct should be weighed by citizens, not politicians, and in a forum where tested proof, not wild allegation and fantasy, is required. That’s how the rule of law is mobilized and expressed," concluded Doyle. "You don’t have to bring every charge you could bring against Trump, or charge every co-conspirator you could charge, to let the jurors speak on one serious federal crime. Start tomorrow."

    Chairman Bennie Thompson (D-MS) is consulting with legal counsel to determine if the Select Committee on the January 6 Attack can issue subpoenas to members of Congress.


    Two Republican lawmakers, Reps. Jim Jordan (D-OH) and Scott Perry (R-PA) have indicated they are refusing to cooperate with the committee’s requests.

    The Guardian’s Hugo Lowell Tuesday afternoon reports Chairman Thompson “tells us just now they’re discussing with counsel about whether they have the authority to issue subpoenas for GOP members of Congress and if it can be enforced.”

    CBS News’ Scott MacFarlane adds that Chairman Thompson just “specified the committee has been in contact with counsel for former VP Mike Pence.”

    The Committee on Monday indicated it was weighing requesting the former Trump vice president’s voluntary appearance.

    Jill Sanborn, executive assistant director of the FBI’s National Security Branch was testifying before the Senate Judiciary Committee. That’s when Sen. Ted Cruz (R-TX) asked some very good questions to which she didn’t have a response. Cruz asked about FBI involvement/informants in the Jan. 6 Capitol riot.

    “How many FBI agents or confidential informants actively participated in the events of January 6th?” Cruz asked. Sanborn said that she couldn’t go into “sources and methods.” Cruz continued asking if any FBI agents or confidential informants participated, to which Sanborn said, “I can’t answer that.” He then asked if any of them committed crimes of violence or incited crimes? Again, she refused to answer.

    Then Cruz went all-in, asking, “Who is Ray Epps?” Ray Epps is a man who has been speculated on a lot because he was very active, encouraging people to go into the Capitol, yet doesn’t appear to have been pursued by the FBI when the FBI seems to be pursuing people who so much as breathed near the Capitol that day.

    Sanborn’s response? “I’m aware of the individual.” But she doesn’t disabuse anyone of the belief that he could be FBI-connected; indeed, her failure to fully respond, got even more tongues talking.

    “Ms. Sanborn, was Ray Epps a fed,” Cruz asked.

    “I cannot answer that,” Sanborn responded. I guess that answers that question right there, which leads to a lot of other questions.

    Cruz noted how five seconds after Epps talks to someone, that person starts to tear down a barricade. Did Epps urge him to tear down the barricade, Cruz asked Sanborn. And again, she said that she couldn’t answer that.

    Cruz said many Americans are concerned that the federal government encouraged illegal activity, noting that — oddly — Epps had been removed from the list that the FBI had put out of people they were looking for in connection to Jan. 6. Sanborn then finally says that “not to her knowledge” did the FBI “actively” encourage violent criminal conduct.


    But she didn’t respond as to the other questions, and her failure to respond was in itself an answer, leaving all kinds of questions about the FBI being involved. She didn’t deny that Epps was an FBI or an informant.

    The House committee investigating the Capitol insurrection on Tuesday formally debunked the right-wing conspiracy theory that Jan. 6 protester Ray Epps was an FBI informant, which had been pushed as recently as hours earlier by Texas Republican Sen. Ted Cruz.

    "The Select Committee is aware of unsupported claims that Ray Epps was an FBI informant based on the fact that he was on the FBI Wanted list and then was removed from that list without being charged," the committee wrote on Twitter. "The Committee has interviewed Epps. Epps informed us that he was not employed by, working with, or acting at the direction of any law enforcement agency on Jan 5th or 6th or at any other time, & that he has never been an informant for the FBI or any other law enforcement agency."



    Rep. Adam Kinzinger (R-IL), a member of the committee, added: "One more @tedcruz conspiracy down. Ray Epps has cooperated and is nothing but a Jan 6 protest attendee, in his own words. Sorry crazies, it ain’t true."

    PolitiFact also recently addressed the claim that Epps was an FBI informant. Epps, a former president of the Arizona Oath Keepers, was seen on video on Jan. 5 and 6 urging others to enter the Capitol "peacefully."

    "Epps’ image was at one point included on the FBI Capitol Violence most wanted list, a website that seeks the public's help in identifying people involved in the riot," PolitiFact reported, adding that because the FBI removed Epps' image in July, right-wing news outlets began to claim that the government was attempting to erase his name from the insurrection.

    "But it could also merely confirm that the FBI is no longer seeking help in locating him," Poiltifact reported. "Other explanations for its removal include the possibility that Epps may have already been interviewed by investigators. ... Epps never appears to have entered the Capitol or engaged in violence as many of the more than 600 others facing charges did. "

    The House Select Committee investigating the Capitol insurrection issued three new subpoenas on Tuesday afternoon.

    The committee subpoenaed two close advisers to Donald Trump Jr., Andy Surabian and Arthur Schwartz, as well as a former White House official who helped craft former president Donald Trump's Jan. 6 speech, Ross Worthington.

    According to Politico, the committee's decision to subpoena two of Trump Jr.'s advisers was "an indication that they’re inching ever closer to the Trump family."

    "The younger Trump has been the source of recent revelations from the committee for pleading with his father amid the violence on Jan. 6 to issue a public denouncement of the rioters," Politico reported. "Trump Jr. lamented that his father’s earlier statements were insufficient to quell the violence and sought a firmer effort."




    The subpoenas require the three to provide documents by Jan. 24 and appear for depositions between Jan. 31 and Feb. 2.

    Rep. Bennie Thompson (D-MS), who chairs the committee, said in a statement: “The Select Committee is seeking information from individuals who were involved with the rally at the Ellipse. Protests on that day escalated into an attack on our democracy. Protestors became rioters who carried out a violent attempt to derail the peaceful transfer of power.”

      But they are also referenced in the phony letter Jeffry Clark tried to get the DOJ to send out telling states the DOJ had concerns about the election, So this looks like another thing that goes straight back to Trump and the White House.

    On Wednesday, writing for CNN, fact-checker Tara Subramaniam tore apart the excuses laid out in a letter by Rep. Jim Jordan (R-OH) for refusing to comply with information requests from the House committee investigating the January 6 Capitol insurrection.

    First of all, Subramaniam looked at Jordan's claim that he has "no relevant information that would assist the Select Committee." "Committee Chair Bennie Thompson requested Jordan's cooperation on the basis that he 'had at least one and possibly multiple communications with President Trump on January 6th.' A January 6 select committee spokesperson said in response to Jordan's letter that due to these communications he does have information the committee is seeking and is a 'material witness.'"

    Then, there was the claim from Jordan that Pelosi "failed to consult with Leader McCarthy" about appointing Republicans, and the committee was thus invalid. "McCarthy initially selected five GOP members to serve on the committee," noted Subramaniam. "Pelosi rejected two, Jordan and Rep. Jim Banks of Indiana, but accepted the other three. However, McCarthy pulled all five members in response to Pelosi's rejection. Pelosi then selected Reps. Liz Cheney and Adam Kinzinger to represent the GOP on the panel."



    Jordan also claimed that Rep. Adam Schiff (D-CA) "doctored" a text message by former White House Chief of Staff Mark Meadows, but in reality, "every word he said was included in Meadows' message." And he claimed that the committee had put telecommunications companies under a "gag order" preventing them from revealing to Trump allies on their networks that they were turning over communications information, but in fact, "after the committee issued its latest round of phone record subpoenas, Verizon did inform its customers they would need to file in court by January 5 if they wanted to try to block the panel from getting the records, according to some of the filings."

    Lastly, noted Subramaniam, Jordan claimed the committee "falsely accused former New York Police Commissioner Bernard Kerik of attending a meeting in Washington on January 5, 2021, when Kerik was actually in New York City." In fact, Kerik helped organize the so-called Trump "command center" at the Willard Hotel whether or not he was physically present there.

    Jordan has given inconsistent answers as to when and how much contact he had with Trump about the activities on January 6. He made public his decision to defy the committee on Sunday, despite maintaining that he has "nothing to hide" about his actions.

    The top Republican in the House of Representatives may be committing highlighting a crime by refusing to cooperate with the House Select Committee to Investigate the Jan. 6 Attack on the U.S. Capitol.

    "Let’s be clear: In refusing to testify to the House select committee examining Jan. 6, House Minority Leader Kevin McCarthy may well be helping to cover up potential crimes committed by Donald Trump," Greg Sargent wrote for The Washington Post.

    McCarthy claimed the committee was illegitimate in declining to cooperate.

    "McCarthy’s refusal may be the most significant moment thus far in the wide-ranging effort by Trump allies to cover up his Jan. 6-related corruption. That’s because McCarthy, who reportedly appealed to Trump as the violence unfolded, likely has some of the most direct knowledge available of Trump’s conduct as the mob rampage continued," Sargent noted. "That could have criminal implications, if Trump’s attempt to subvert the electoral count in Congress amounted to an effort to obstruct an official proceeding."



    New York University School of Law Prof. Ryan Goodman explained why it is so important for the select committee to learn more about McCarthy's experience on Jan. 6.

    “There’s no doubt that McCarthy is a material witness to a possible crime by the former president,” Goodman said. “His conversation with Trump during the height of the riot could provide direct evidence of Trump’s mind-set and scheme.”

    “Trump’s greatest legal exposure is for the criminal obstruction of congressional proceedings, and McCarthy appears to have direct evidence that goes to the heart of what’s needed to prove that crime,” Goodman explained.

    Jan. 6 panel subpoenas Facebook, Twitter, Reddit and YouTube

    The House committee investigating the Jan. 6, 2021, attack on the Capitol subpoenaed some of the country’s largest social media and tech companies on Thursday, arguing they had not been forthcoming following an August request for information.

    The four subpoenas were sent to Facebook parent company Meta, Twitter, Reddit and Alphabet's YouTube.

    “Two key questions for the Select Committee are how the spread of misinformation and violent extremism contributed to the violent attack on our democracy, and what steps—if any—social media companies took to prevent their platforms from being breeding grounds for radicalizing people to violence,” Committee Chair Bennie Thompson (D-Miss.) said in a statement.

    “It’s disappointing that after months of engagement, we still do not have the documents and information necessary to answer those basic questions.”

    In one of its first formal actions, the committee in late August sent a request to 15 websites and tech companies, asking them to preserve records tied to the Jan. 6 riot.

    The panel requested internal and external reviews of 2020 election misinformation or violent extremism, all content given to law enforcement related to those subjects and all relevant internal communications.

    The goal has been to ascertain how social media was used to organize the attack, the extent the sites contribute to radicalization and the spread of disinformation, and what the companies know about their use in the attack itself.

    But the sweeping request for information seems to have largely come to a standstill with some of the tech giants, the panel said.

    “After over four months of good-faith negotiations on the part of the Select Committee, it has become clear that Twitter is unwilling to commit to voluntarily and expeditiously complying with the Select Committee’s requests,” the committee wrote in a subpoena to the company.

    The committee saved some of its harshest words for Twitter, saying the company had failed to “even commit to a timeline” for turning over documents.

    That includes a request about reported warnings the company received about “use of the platform to plan or incite violence on January 6th,” its decision to remove former President Trump from the platform, or any of its own internal analyses regarding how the site was used surrounding the 2020 election.

    Twitter did not respond to request for comment.

    The letter to Facebook, now under parent company Meta, says the tech giant likewise failed to commit to a timeline for turning documents over to the panel, which also requested internal analyses for how extremists used the platform leading up to the election.

    “People used Meta’s platforms in the months and days before January 6, 2021, to share messages of hate, violence, and incitement, to spread misinformation, disinformation, and conspiracy theories,” the committee wrote.

    The committee cites public statements from former Facebook employee and whistleblower Frances Haugen, who leaked internal company research that in part called into question the tech giant’s content moderation policies, especially in relation to activity of certain high profile public figures, including Trump.

    Haugen, a former Facebook product manager, also told a Senate panel in October that Facebook dissolved the civic integrity team she worked on after the 2020 election and before the Jan. 6 attack.

    Facebook has previously pushed back on the claim, stating it “did not disband Civic Integrity,” but rather “integrated it into a larger Central Integrity Team.”

    The letter to YouTube, like Twitter, seeks information about the platform’s decision to suspend Trump’s account and “whether or why the platform did or did not act regarding President Trump’s account in advance of January 6th.”

    It also asked about the company’s election misinformation content moderation policy, which initially included a suspension grace period that was done away with after Jan. 6.

    Both Facebook and Alphabet sought to push back on the committee’s claims that they had not been cooperative.

    "As Chairman Thompson said recently, 'Facebook is working with [the committee] to provide the necessary information we requested.' Since then, Meta has produced documents to the committee on a schedule committee staff requested - and we will continue to do so," the company said in a statement, pointing to comments Thompson made to CBS News in October.

    Alphabet said it has been cooperating with the committee since the start of the investigation and has responded “substantively to their requests for documents.”

    “We have strict policies prohibiting content that incites violence or undermines trust in elections across YouTube and Google's products, and we enforced these policies in the run-up to January 6 and continue to do so today. We remain vigilant and are committed to protecting our platforms from abuse,” the company added.

    The letter to Reddit notes the company restricted the use of a page dedicated to Trump in both 2019 and early 2020 for violating its content rules before suspending the subreddit r/TheDonald in June of that year. Just two days after the Jan. 6, 2021 riot, the site shut down another similar page.

    The request is part of an effort to understand what steps social media companies “could have taken or did take to limit the use of their platforms for those purposes; and what impact any such actions did or did not have.”

    "We received the subpoena and will continue to work with the committee on their requests," Reddit said in a statement.
