    There are a multitude of things the January 6th commission is investigating that the FBI is not. Most notably who helped organize and fund the violent insurrection and attempted coup. And who all was involved including members of Congress.


    Pelosi suggests Jan. 6 panel could investigate Jordan and Banks

    Speaker Nancy Pelosi (D-Calif.) indicated in an interview released on Monday that the two Republicans she rejected to serve on the select committee investigating the Jan. 6 insurrection could be scrutinized as part of its work.

    During an interview with The 19th News, Pelosi said that she vetoed Republican Reps. Jim Banks (Ind.) and Jim Jordan (Ohio) from serving on the committee because she thought they were "outrageous" and "not serious."

    "I mean, they probably — " Pelosi began, adding, "Well, we'll see what the committee finds out about them, but they weren't going to be on the committee."

    "There would be antics and clowns and not serious about this and still participants in the big lie,"
    Pelosi said, referring to former President Trump's false claims that the election was stolen from him. "I didn't really care if they had voted to accept the results of the election or not. All I wanted them to be is willing to seek the truth."

    Banks and Jordan are two of Trump's most vocal supporters in Congress and have echoed the former president's false claims of election fraud. Banks also recently organized a delegation of House Republicans to the U.S.-Mexico border with Trump.

    Banks on Monday accused Pelosi of using the select committee to target her political opponents by suggesting he and Jordan could be investigated.

    "That is an abuse of power and if she follows through she needs to be held accountable. It is banana republic style politics that doesn’t belong in America. If Democrats had integrity, they would condemn this behavior at home with the same enthusiasm with which they condemn it abroad," Banks said in a statement.

    Once Pelosi vetoed Banks and Jordan, House Minority Leader Kevin McCarthy (R-Calif.) withdrew his three other picks to serve on the panel and announced that the GOP conference would boycott the proceedings altogether.

    The two Republicans who are serving on the committee, Reps. Liz Cheney (Wyo.) and Adam Kinzinger (Ill.), were both tapped by Pelosi.

    Cheney and Kinzinger were among the 10 House Republicans who voted to impeach Trump for inciting the Jan. 6 attack on the Capitol and have been vocal critics of their party's leadership for continuing to embrace the former president.

    Pelosi praised Cheney as "just as courageous a person I've ever seen in the Congress of the United States" and Kinzinger as "similarly courageous to go down that path."

    Cheney previously said that Jordan "may well be a material witness to events that led to" Jan. 6.

    Jordan has confirmed that he spoke with Trump on Jan. 6, which could lead the select committee to ask him what he discussed with the former president that day.


    When asked in an interview with Spectrum News late last month if he had spoken with Trump on Jan. 6, Jordan replied, "Yeah I mean — I spoke with the president last week, I speak with the president all of the time. I spoke with him on Jan. 6. I mean, I talked with President Trump all the time and that's ... I don't think that's unusual. I would expect members of Congress to talk with the president of the United States when they're trying to get done the things they told the voters in their district to do."

    But Jordan didn't specify whether he spoke with Trump before, during or after the Capitol was attacked by a mob of the former president's supporters.

    “I spoke with him that day, after? I think after. I don't know if I spoke with him in the morning or not. I just don't know. ... I don't know when those conversations happened,” Jordan said.

    I am all for this but I doubt the select committee investigating 1/6 are. I suspect they are sitting on a ton of video and documents the public has not seen yet and they don't want to have to put the cart before the horse until they've had a chance to go through all they have and put it in context with other evidence and testimony.

    Journalist sues Congress for Jan. 6 surveillance footage, other records

    A freelance journalist is suing Congress for footage and other records pertaining to the Jan. 6 Capitol attack, challenging the legislative branch's lack of legal transparency requirements.

    Shawn Musgrave filed a lawsuit in Washington, D.C., federal district court on Wednesday asking a judge to recognize a "common law right of access" to congressional records, which are exempt from public records laws like the Freedom of Information Act (FOIA).

    "The result of FOIA inapplicability, in combination with almost nothing requiring further transparency to the public from these offices, has roundly led to low transparency and high secrecy," the complaint reads. "This lack of transparency has become even more apparent in the face of increased public interest in congressional security in the wake of 6 January.

    "However, these offices are subject to the common law right of access to public records, as all three branches of government are subject to that right."

    The lawsuit was filed against the U.S. Capitol Police, the House Sergeant at Arms and the Senate Sergeant at Arms. None of those offices were immediately able to offer comment to The Hill.

    Musgrave is seeking surveillance footage of the riot and records about the Capitol's security measures, arguing that "increased USCP transparency generally would have been helpful in preventing and/or understanding 6 January and is likely to be important in preventing similar attacks from happening in the future."

    Musgrave also filed a similar lawsuit on Wednesday against the Senate Intelligence Committee and its chairman, Sen. Mark Warner (D-Va.), seeking to make public the panel's full torture report, which has been available only in a highly redacted version since its release in 2014.

    It's unclear whether Musgrave will be able to convince federal judges that the legislative branch has an implied legal obligation to disclose the materials in either case. But if he's successful, it could upend the lack of transparency surrounding Congress and its voluminous nonpublic records.

    The January 6th select committee in the House held the first hearing with police ahead of the August recess, and now that members are coming back to work, the committee is looking at the next steps.

    CNN.com reported Monday that the committee will look at phone records of any members of Congress who may have been in contact with organizers of the violent riots

    Rep. Mikie Sherrill (D-NJ) said that she witnessed "members of Congress who had groups coming through the Capitol ... a reconnaissance for the next day." She explained that she found it suspicious because the Capitol was closed due to COVID-19 and tours weren't happening.

    Rep. Sean Patrick Maloney (D-NY) later echoed that claim by saying that he spoke to another member who also witnessed a tour that day.

    In January, Sherrill joined with more than 30 other Democrats in authoring a letter requesting that the Capitol Police and the acting sergeants at arms, in both the House and Senate, investigate "suspicious behavior and access given to visitors to the Capitol Complex" on Jan. 5.

    The CNN report said that the House intends to tell telecommunications companies to preserve documents. Rep. Bennie Thompson (D-MS), the chairman of the committee, said that he hopes to have subpoenas issued by the end of the month.

    "While it remains unclear which members' records the committee is interested in, several Republican lawmakers, including House Minority Leader Kevin McCarthy and GOP Rep. Jim Jordan, have acknowledged speaking to then-President Donald Trump by phone on January 6," said the report.

    Jordan was asked by two reporters about his conversations with Trump on Jan. 6 and stammered so much that questions were raised about him hiding something.

    "We have quite an exhaustive list of people. I won't tell you who they are. But it's several hundred people that make up the list of individuals we plan to contact," said Thompson.

    The CNN report also said that the Democrats used similar language Republicans used for their Benghazi investigation.

    "It also appears that the Committee could have limitless resources. Though the group has yet to clarify how much it intends to spend, the flexible language dictating its funding mirrors the framework for the select committee investigating the 2012 terrorist attack in Benghazi. That committee ended up spending close to $7 million over two years," the report explained.

    In a press release from this Wednesday, the Committee announced that the move was a follow-up to the July 27 hearing at which four police officers testified about their experiences trying to hold back the mob of Trump supporters who were trying to breach the Capitol building that day.

    "The Select Committee to Investigate the January 6th Attack on the United States Capitol is examining the facts, circumstances, and causes of the January 6th attack. Our Constitution provides for a peaceful transfer of power, and this investigation seeks to evaluate threats to that process, identify lessons learned and recommend laws, policies, procedures, rules, or regulations necessary to protect our republic in the future," wrote Chairman Bennie G. Thompson (D-MS).

    Among the matters the Committee is seeking clarity on are "the gathering and dissemination of intelligence in advance of the attack; security preparations around the U.S. Capitol; the role agencies played in the defense of the Capitol on January 6th, the planning and organization of events in Washington, DC, on January 5th and 6th; and how the January 6th events fit in the continuum of efforts to subvert the rule of law, overturn the results of the November 3, 2020 election, or otherwise impede the peaceful transfer of power."

    In a column for CNN, one of the legal counsels who worked on Donald Trump's second impeachment praised the work so far done by the House select committee investigating the Jan. 6th insurrection that led to lawmakers from both sides of the aisle fleeing for their lives.

    According to Norm Eisen, who served as President Barack Obama's ethics czar, the move by the committee to get phone records from lawmakers and members of the Trump's family is evidence of a "classic investigative technique" and the former president has few legal avenues to stop them.

    Previously, when he was still president, Trump invoked executive privilege to keep his inner circle from testifying during his two impeachment trials. Now that he is out of office, he can attempt to invoke it again but recent rulings by the courts in matters involving Trump and secrecy have not gone in his favor.

    Eisen noted that the Justice Department under President Joe Biden and his Attorney General Merrick Garland have already declared that executive privilege no longer applies and that officials called before the committee can be expected to comply.

    "The administration has waived executive privilege and allowed former Trump administration officials to provide testimony to Congress about the ex-president's attacks on the 2020 election and its certification," Eisen wrote before adding, "The US Department of Justice correctly reasoned that the 'extraordinary events in this matter constitute exceptional circumstances ... [and] the congressional need for information outweighs the Executive Branch's interest in maintaining confidentiality.'"

    Writing, "If Trump tests the committee in court, he will find that the law of executive privilege is not in his favor," the attorney explained, "So, Trump could go to court and seek an injunction, arguing that he's the owner of the privilege. But the tenor of the law makes it likely that he would lose -- which may be why Trump did not attempt to stop those former officials from testifying in the first place."

    The problem for the former president is that the one person who could help him out would be President Joe Biden -- an unlikely occurrence.

    "The general rule is that the privilege belongs to the nation, not to any former incumbent -- and the Biden administration has already demonstrated its inclination to waive," Eisen contended. "Together with the demands we learned about earlier this week for phone and other records from telecom and social media companies, all of that makes it likely that the truth will be uncovered. Private companies are not going to fool around either."

    "A common investigative adage is 'follow the money.' Here, Congress should follow Trump's lies, especially the big lie that the election was stolen. The 1/6 committee is off to a good start doing just that, and there is ultimately little that Trump will be able to do to stop it," he concluded.

    There sure are some fucked up folks in this world, and trust me when I say the U.S. has our fair share of them, most of them are elected politicians, and the others are challenged attention whores, much like the elected politicians...

    However, in a nut shell, this little January 6th Commission is nothing other than the hack fucks demonstrating that this will never happen again...a revolt against the corrupted political elitists that know better than the common peasants it rules over....and they will never ever be questioned about how they say it should be.

    That was a pure panic move that really blew up in his face. McCarthy as well as a few other treasonous conservative/Republicans are openly trying to obstruct justice which screams they are terrified of what they are hiding coming out.
