One thing is 100-percent clear, however: This federal pardon power does not touch state law. That is definitely something to think about, as some legal experts are arguing that POTUS’s phone call did not just break federal law, but state law too.

Law Professor Jed Shugerman of the Fordham University School of Law suggested that Trump “arguably” violated both versions of criminal solicitation of election fraud.

The most damaging part of the call is when Trump says that the Secretary of State should just say he “retabulated” the numbers. It reveals that he isn’t blowing off steam or sincerely seeking out the truth. His only demand is to have votes tossed or invented to fabricate a win.

Between that and “we need” the number of votes Biden won by plus one is just an astonishing demand. There’s no way to read this other than a blatant attempt to pressure Georgia officials to lie and alter legitimate election results with a wink and a nod to a looming consequence.

“If any other person did this – someone else with power to leverage over an election official – there is no doubt in my mind that at the very least a criminal investigation would be opened right away,” Kreis told Reuters.

The matter of federal self-pardon is another matter completely. Writing in context of the Russia probe, attorney and Law&Crime analyst Elura Nanos argued in 2017 that Trump can likely issue a self-pardon because in Article II, Section 2 of the U.S. Constitution, the “only limits placed on the power are that pardons may only be issued for federal offenses (not civil or state crimes), and a pardon cannot override the Congress’ impeachment power.” She stood by that analysis when we reached out to her on Sunday, though she pointed out an important element in this case.

“Keep in mind that the one issue is that if criminal charges were never actually brought, the timing of a preemptive pardon might be problematic,” she told us.

As she wrote in her 2017 op-ed, President Gerald Ford‘s pardon of predecessor Richard Nixon was controversial because it was preemptive, and the legal question underlying this remains untested. From her article:

A blanket absolution for all offenses that stymies a prosecution before it even happens? That’s got “Trump” written all over it. Ford’s pardon of Nixon wasn’t without it’s own controversy, as some legal scholars argued that its preemptive nature exceeded the bounds of Ford’s constitutional authority. Others raised the counterargument that that pardons are properly timed so long as they are issued after the commission of a crime – not necessarily after the proof at trial of that crime. Both arguments make some sense, and neither has been tested, so it’s tough to say what would happen if the issue were raised in court by the Trump administration or its opponents.

Trump signed the Families First Coronavirus Response act, which American families and businesses impacted by COVID-19 would receive the strong support they needed.

The president created the White House Coronavirus Task Force to coordinate the government’s response.

Named Vice President Mike Pence to head lead the task force, who then appointed Dr. Deborah Birx to coordinate the White House Coronavirus Response.

President Trump held numerous teleconferences with that nation’s governors to coordinate response efforts and to assure federal support.

President Trump approved major disaster declarations for severely impacted states, such as New York, Washington, and California.

The accomplishments above are only a miniscule part of what the Trump administration has done in response to the GLOBAL pandemic, a fact which Biden and the Democrats seem to forget. This isn’t an American virus…it’s a worldwide virus.

Republicans ought to be calling for Trump's resignation or end the GOP: Veteran reporter Carl Bernstein

Veteran Watergate reporter Carl Bernstein responded to the shocking tapes of President Donald Trump attempting to extort the Georgia Secretary of State, saying that it is "far worse than what occurred in Watergate."

Speaking to CNN's Fredricka Whitfield on Sunday afternoon, Bernstein said that these tapes prove that Trump isn't merely a criminal, he's also subversive.

"At the same time this one person subverting the very basis of our democracy, and willing to act criminally in that subversion," said Bernstein. "But more importantly, what we hear on this tape -- this is the ultimate smoking gun tape. It is the tape with the evidence of what this president is willing to do toll undermine the electoral system and illegally, improperly, and immorally try to instigate a coup in which he remains the president of the United States."

He explained that in a normal White House the new Trump tape would be enough to impeach and remove the president and draw a serious investigation from the Justice Department.

"In any other presidency, this tape would be evidence enough to result in the impeachment of the president of the United States, his conviction in the Senate of the United States, and really an immediate call by the members of Congress, including of his own party, that he resign immediately," said Bernstein. "That's really what we ought to be hearing. 'Mr. President, resign, leave the White House, this is unconscionable, it is wrong, and we of your party will not permit it.' We won't hear it. We might form a few Republicans, but that's what's really called from here. The heroes of the Watergate were Republicans who would not tolerate Richard Nixon's conduct."

He went on to call the demand by Trump for Georgia Secretary of State Brad Raffensperger to come up with the votes for him "plus one" and illegally deliver the election "criminal."

"We've never had a tape like this before, including the Nixon tapes," he continued. "As for heroes yes, the secretary of state of Georgia is a hero, but so are hundreds of election officials and state officials who have done their job, stuck with it, despite threats, including to their safety and health. We have a number of heroes here. Where we have not had heroes is the Senate of the United States, particularly Republican members, except for a few who have been craven, refusing to condemn this kind of out of control conduct, and the real disgrace in the House of Representatives, more than 140 probably a majority in the Republicans in the House, willing to promulgate and continue this idea, despite the evidence of upending a legal, proper election in which the evidence is clear, the results are clear? This is fantasy. It's not delusion, because they know what they're doinghis is fantasy. It's not delusion, because they know what they're doing. And the question is: is some real leader of the Republican Party" going to stand up?

He noted that Rep. Liz Cheney (R-WY) has done it but Senate Majority Leader Mitch McConnell certainly hasn't and Bernstein said he doubts McConnell will. If he did, however, Bernstein said that it would curtail some of the irrational behavior in the Senate, but that it wouldn't put an end to it.

"Also in the long run, I don't have a crystal ball, but I would think that the Republican Party, this presidency, particularly in its end and supporting what this president is doing in the final days of his presidency -- may be the end of the Republican Party as a constructive, decent source," he went on.

"All these Republicans from [Sen. Ted] Cruz (R-TX) all the rest of them who have participated in this sham, should be made to pay. This is not about two, simple, equal sides of an equation. There are no two sides to this question," Bernstein closed. "This is about democracy, fundamental principles and the astonishing thing is to see one of the great political parties, the party of Lincoln, the party of Eisenhower, etc, etc. What was also for a while the party of McCarthy, and now we have for the first time a president of the United States who has exceeded McCarthy's authoritarianism, his disrespect for the Constitution, the rule of law, and the Republican Party of our time with McConnell's leadership, with [Rep. Kevin] McCarthy's (R-CA) leadership, has gone along with it to their disgrace."

President Trump pushes Ga. secy of state to reexamine election results

President Trump reportedly pushed Georgia Secretary of State Brad Raffensperger to dig deeper into the state’s election results.

This is according to a phone call released on Sunday in which Raffensperger and his legal counsel rejected claims of election irregularities.

The President pointed to stories of ballots being shredded and voting machines being moved, accusing Raffensperger of knowing what happened but not reporting it.

“You should want to have an accurate election,” President Trump told the secretary of state. “And you’re a Republican.”

Raffensperger responded by saying, “We believe that we do have an accurate election.”

Raffensperger continued to stand by the numbers, claiming he believes they are correct. President Trump countered, telling Raffensperger that he’s providing faulty election results and the people of Georgia know it’s a scam.

Unusual activity near President Donald Trump's golf resort in Scotland has set off rumors that he might be fleeing there before Joe Biden's inauguration.

Prestwick airport, which is near Trump's Turnberry resort, was told to expect the arrival on Jan. 19 of a U.S. military Boeing 757 plane the president has reportedly used before, reported the Sunday Post.

"There is a booking for an American military version of the Boeing 757 on Jan. 19, the day before the inauguration," a source with Prestwick airport told the Post. "That's one that's normally used by the vice president but often used by the first lady. Presidential flights tend to get booked far in advance, because of the work that has to be done around it."

Several U.S. Army aircraft have been seen performing surveillance above Trump's flagship golf resort starting Nov. 12, several days after Biden was projected as the winner of the presidential election.

"The survey aircraft was based at Prestwick for about a week," an airport source said. "It is usually a sign Trump is going to be somewhere for an extended period."

Donald Trump had a second cabinet official resign on the day after his supporters waged a violent insurrection at the U.S. Capitol.

"We should be highlighting and celebrating your Administration's many accomplishments on behalf of the American people," DeVos wrote in her resignation letter, as reported by The Wall Street Journal.
