Giuliani: Trump’s tax audits have been ‘completed and accepted’ — except maybe not

Former Lifelock spokesperson Rudy Giuliani tells Salon that the audits of President Trump’s tax returns have been “completed and accepted,” except for “possibly not most recent.”

Giuliani was confirming claims he made Sunday morning to Fox News host Maria Bartiromo. This new story, however, seems to undermine the president’s excuse that he can’t release his returns because they are under audit, a line he has been repeating since the 2016 campaign.

Last Thursday, following the Supreme Court’s 7-2 ruling that the Manhattan district attorney can subpoena the president’s tax returns, White House press secretary Kayleigh McEnany repeated the excuse to reporters, saying, “The media’s been asking this question for four years, and for four years, the president has said the same thing, his taxes are under audit, and when they’re no longer under audit, he will release them.”

In a separate case about Congress requesting the president’s financial documents, which the court effectively delayed until after the election, Justice Ruth Bader Ginsburg had pushed the audit issue with one of Trump’s attorneys, who avoided responding directly.

“Every president voluntarily turned over his tax returns, so it gets to be a pitched battle, because President Trump is the first one to refuse to do that,” she said this spring. “Initially, he said because of an audit was ongoing. Now, it seems to be broader than that.”

In 2019 an IRS whistleblower turned evidence over to Congress reportedly showing “inappropriate conduct” on Trump’s returns.

But Giuliani said that prosecutors have “no reason to believe that there’s anything wrong with his tax returns,” because “all of them have been audited, all of them have either been passed on or settled.” The former mayor of New York City allowed for an exception: “maybe not the last one.”

Giuliani added this in a text message, which we publish verbatim:

Since there are. Always extensions can’t be sure. Really not sure if there is one or two not completed but almost all are and they are done.

Those last “one or two” would be the returns has Trump filed as president. “The last one” would be fiscal year 2018, the year Giuliani says he took on Trump as his client, pro bono.

When Salon asked Giuliani if he meant that Trump’s returns had been audited each year up through 2018, Giuliani replied that he “didn’t specify.”

The former face of Fraud Guarantee LLC explained that these specific claims of fact about Trump’s returns had derived from his “general knowledge of how taxes are handled.”

He did not respond when asked whether this meant that he himself had also been audited every year, and that this was a common experience for people.

“All you have to do is know how they work and most are gone now or an action would be brought because of statute of limitations,” Giuliani said in a text message.

Whatever his protestations, Giuliani appears to have made conclusive claims about knowledge of facts regarding his client that pertain directly to an ongoing criminal investigation.

The Manhattan DA’s office had sought eight years of Trump’s business and tax records in connection with its investigation into hush-money payments made on Trump’s behalf just ahead of the 2016 election.

Trump and the Trump Organization both reimbursed Michael Cohen, Giuliani’s predecessor as the president’s former personal lawyer and fixer, for payments made to pornographic film actress Stormy Daniels. Cohen was also involved in payments to former Playboy model Karen McDougal. Both women claim to have had affairs with Trump.

While Giuliani appeared to be attempting to defend his client, however, he seems instead to have directly contradicted Trump, including official White House statements given as recently as last week.

Those claims of fact would seem on their face to violate attorney-client privilege, a favorite exit ramp for Giuliani, which he has used numerous times throughout the Ukraine impeachment saga in media interviews about his relationships with Trump, Lev Parnas, Igor Fruman and husband-and-wife attorney team Joseph diGenova and Victoria Toensing. At the time, Trump also alluded to the privilege.

In 2017 Giuliani told Fox News personality Sean Hannity that Trump had repaid Cohen for the Daniels payoff.

“They funneled through a law firm, and the president repaid it,” he said.

“Oh. I didn’t know that,” Hannity replied. “He did?”

“Yep,” Giuliani said.

Cohen said the American Civil Liberties Union is representing him in the matter.

Today, the Ninth Circuit Court of Appeals issued an opinion reversing a jury verdict and ordering dismissal of a case that was the biggest of Michael Avenatti’s career in his prior profession as an attorney in Southern California.

The case was a class-action lawsuit brought by Avenatti on behalf of Plaintiff Bahamas Surgery Center and against defendant multinational health care company Kimberly-Clark Corp. (KCC).

The allegations of the case were that KCC had sold hundreds of millions of dollars worth of surgical gowns through co-defendant distributor Halyard Co, which were labeled as being compliant with a certain industry-recognized standard for being a liquid bio-hazard barrier, when those gowns did not, in fact, meet the industry-standard as represented.

As described in reporting at the time, the Los Angeles federal court jury that heard the case — only six jurors in a federal civil case — was largely younger adults in their 20s, and Avenatti tailored his presentation, including his manner of speaking, to the audience.

In the end, he was richly rewarded for his efforts, as the jury returned a verdict of general and punitive damages in the amount of $454 million for the members of the class that Avenatti was representing — all buyers of such mislabeled surgical gowns during the time period specified in the complaint.

One problem which Avenatti ran into in the aftermath of the jury’s verdict was with the federal District Court Judge. He tossed out the substantial punitive damages award and reduced the verdict to only $25 million.

Today, the Ninth Circuit applied the coup de grace. They tossed out the verdict altogether AND remanded the matter with instructions that the case be dismissed.

What had Avenatti done wrong??? In a STUNNING BIT OF POTENTIAL MALPRACTICE, Avenatti had taken a class-action case to trial with a Class Representative Plaintiff who had not been damaged — Bahamas Surgical Center had never purchased any the KCC manufactured gowns at issue.

Bahamas has no claim against Halyard [distributor of KCC gowns] because it purchased no gowns from it, and any injuries it has are not traceable to Halyard’s conduct. Without a claim of its own, Bahamas cannot “‘seek relief on behalf of [itself] or any other member of the class.’”

In a class-action case, the Class Plaintiff “stands in” for all other persons similarly situated and with substantially similar claims against the same defendant. To do that it is necessary that the Class Representative be — you know — representative of the class. One way that is established is by the fact that the Class Representative has a substantially identical claim against the defendant as all other members of the Class being represented.

This must have come up at some point in the discovery process. The Ninth Circuit puts fault on the District Court for certifying the class when Bahamas was not a representative plaintiff.

But there was no reason for Avenatti to not have moved to amend the complaint to add new Class Representatives when this issue came up.

The claims against KCC may have been sound and based in substantial facts. But this procedural error by Avenatti has all the class members now in a position of having to start over again.

Once the crowning glory of Avenatti’s Los Angeles legal career, this case is now worth zip, zero, nada.

Rudy Giuliani’s Ukrainian henchmen are still trying to smear Joe Biden — but their campaign is flailing

Rudy Giuliani’s schemes to dig up dirt on former Vice President Joe Biden in Ukraine led to President Donald Trump’s impeachment — but it looks like the attempted smear campaign against the presumptive 2020 Democratic presidential nominee is still operational.

BuzzFeed News reports that Ukrainian Giuliani henchman Andriy Telizhenko is still vowing to spill dirt on Biden ahead of the 2020 presidential election, although whether it gets taken seriously outside of the circle of Trump loyalists remains in question.

That’s because, according to BuzzFeed, Telizhenko is surrounding himself with shady characters who all have assorted Kremlin ties.

“Telizhenko’s Ukrainian collaborators, whose names surfaced during the Trump impeachment saga, include a fugitive, a tainted former prosecutor, and the son of a KGB officer who also was trained in Russian spy techniques,” the publication notes.

Among other things, Giuliani’s Ukrainian crew claims to have obtained secret phone conversations purportedly between Biden and former Ukrainian president Petro Poroshenko, although Poroshenko’s office has called the audio of the calls a forgery.

What’s more, even if the recordings are genuine, the ones that have been released so far are not incriminating.

“The recordings have done nothing to substantiate, let alone advance, the accusations from Trump, Giuliani, and Republicans of Biden corruption in Ukraine,” writes BuzzFeed.

Former Trump Lawyer Michael Cohen Released From Prison—Again

Michael Cohen was released from prison Friday after a Manhattan federal judge ruled federal authorities “retaliated” against the former Trump lawyer for writing a tell-all book about the president. On Thursday, U.S. District Judge Alvin K. Hellerstein said that Cohen could return to home confinement without restrictions after he was thrown back into prison on July 9 for refusing to sign an agreement that allowed him to remain home as long as he didn’t publish his book. Hellerstein said that during his 21 years on the bench he had never “seen such a clause,” adding “How can I take any other inference but that it was retaliatory?” He agreed with Cohen that it was a violation of Cohen’s First Amendment rights.

Cohen, who was sentenced to three years in prison for lying to Congress about hush-money payments and plans to build a Trump Tower in Moscow, was allowed in May to go home due to concerns about the coronavirus. After the July order back to prison, Cohen sued Attorney General William Barr and the Bureau of Prisons director.

Court Orders Trump To Pay $44,100 For Stormy Daniels’ Legal Fees..............
LOS ANGELES (AP) — A California court ordered President Donald Trump this week to pay $44,100 in attorney fees to porn actress Stormy Daniels to pay for her legal battle over her effort to cancel a hush money deal brokered to keep her quiet about their sexual relationship a decade ago.

The order in Superior Court in Los Angeles determined Daniels won her lawsuit against Trump over the agreement that was signed 11 days before the 2016 presidential election. As a part of that deal, the losing party would pay the lawyers fees.

The White House did not immediately respond to a request for comment about the decision.

The president’s personal lawyer at the time, Michael Cohen, paid $130,000 to Daniels, who filed the suit under her legal name Stephanie Clifford. After Trump’s election, Daniels sued to void the agreement.

Trump and his supporters denied the president knew about the payment for several years before Trump acknowledged it on Twitter in May 2018 and said he reimbursed Cohen for the money paid to Daniels.

Daniels’ suit over the non-disclosure agreement was dismissed before going to trial or a settlement because the parties were no longer quiet. Trump’s lawyers said Daniels didn’t win the case and therefore wasn’t entitled to lawyer fees, but Judge Robert Broadbelt III disagreed in his ruling Monday, posted online by Daniels’ lawyers.

Trump’s lawyers also argued Daniels didn’t prove the president was a part of the non-disclosure agreement which was made under the name “ David Dennison,” but Broadbelt wrote there was a large amount of evidence showing Cohen chose Dennison as a pseudonym for Trump.

After her lawyer announced the decision, Daniels wrote on Twitter: “Yup. Another win.”

But they haven’t all been wins for Daniels. She also sued Trump for defamation after the president’s comments on Twitter that a man she said threatened her to stay quiet about their alleged affair in 2011 was “nonexistent.” Trump also posted side-by-side photos of the composite sketch of the man making the threats and Daniels’ husband.

The defamation lawsuit was thrown out and Daniels is appealing the decision and an order to pay Trump almost $300,000 in attorney fees.

A judge in that case ruled Trump’s statements on Twitter were protected speech under the First Amendment.

Since Trump’s election, Daniels has remained in the adult entertainment industry, using her new fame to promote strip club appearances and shows, including her latest venture called “Spooky Babes Paranormal Show” where she said she is leading a team of investigators to hunt ghosts and get answers for people here on Earth. She also still takes shots at the president on Twitter.

Meanwhile, Cohen pleaded guilty to campaign finance charges and lying to Congress, among other crimes, and was sentenced to three years in prison in 2018.

Donald Trump defense attorney Rudy Giuliani admitted on Thursday that he may have been played as a fool by Russia in his efforts to slime Joe Biden.

On Thursday, the U.S. Treasury Department accused Andriy Derkach of being “an active Russian agent for over a decade.”

Giuliani met with Derkach in his efforts to efforts to pin a Ukrainian scandal on Biden, which was part of the series of events over which Trump was impeached.

“Giuliani said in an interview Thursday night that he ‘felt comfortable’ meeting with Mr. Derkach ‘because there were no sanctions against him’ at the time,” The New York Times reported Thursday. “While he acknowledged that he ‘didn’t do much investigation’ of Mr. Derkach, Mr. Giuliani said: ‘I have no reason to believe he is a Russian agent. There is nothing I saw that said he was a Russian agent. There is nothing he gave me that seemed to come from Russia at all.’ But he added, ‘How the hell would I know?'”

Donald Trump defense attorney and former New York City Mayor Rudy Giuliani has once again found himself in a scandal revealed through his difficulties navigating technology.

“Trump’s personal lawyer Rudy Giuliani was caught mocking Asians and even pantomiming a bow in video footage his team accidentally posted to his YouTube page on Wednesday. The remarks came well after Giuliani had finished interviewing former White House Press Secretary Sean Spicer for his podcast, Common Sense. The taping appeared to take place on Tuesday. But a version of it was also posted as a video online on Wednesday. And in that video, the editors not only kept rolling but posted that excess footage along with the Spicer interview,” The Daily Beast reported Wednesday.

“For several minutes on the extended YouTube version, the screen was black and silent. Then Spicer appeared briefly to sign out, leaving Giuliani at his desk speaking with individuals off-screen, apparently unaware the camera was still recording,” The Beast explained.

Giuliani also pantomimed bowing.

“This isn’t the first time that the former New York mayor’s has had an embarrassing run-in with modern technology, resulting in Giuliani revealing more than he wanted. Late last year, the Trump attorney mistakenly butt-dialed an NBC reporter late at night,” The Beast noted. “When the reporter woke up, he discovered a three-minute-long voice message from Giuliani, featuring the ex-mayor discussing overseas dealings and his need for cash. That butt-dial came 18 days after another one in which a different reporter also let it Giuliani’s call go to voicemail, only to later discover Giuliani complaining to another person about becoming the target of public attacks because he slammed a powerful Democrat.”

After Maddow noted that the dirt Rudy Giuliani has recently been peddling on Biden and his son Hunter is now being investigated as a foreign intelligence operation, Caroline Giuliani said that while she had “no inside information” on any of it, she “just thought maybe I could be the other October surprise” with her essay.

The MSNBC host also asked about Rudy Giuliani’s state of mind, noting that a number of people have said they no longer recognize the former New York City mayor and are worried about his mental stability and health. “Have you been concerned about his public behavior at all?” Maddow wondered aloud.

“I mean, I’ve certainly been concerned about his public behavior, not for those reasons, per se,” Caroline Giuliani replied. “But just because he’s involved in this whole group of people doing these things. Donald Trump’s advisors are worried his personal defense attorney’s efforts to slime Joe Biden’s son Hunter will end up backfiring and harming the president’s re-election campaign, according to a new report in The Daily Beast.

“As President Donald Trump’s personal attorney Rudy Giuliani attempts to alter the course of the election through the leaking of materials allegedly from the computer of Hunter Biden, fellow Republicans—including some in the president’s orbit—are holding their breath,” Will Sommer, Asawin Suebsaeng and Sam Stein reported Monday evening.

“Some of Trump’s staunchest allies conceded recently that they are reluctant to attack former Vice President Joe Biden and his son Hunter over the more salacious content purportedly found on the now infamous laptop. Raising concerns about Hunter Biden’s overseas business ethics may be kosher, they argue. But going after his personal demons by attacking his drug use, suggesting the existence of lurid photos, and using it all as a means to question Joe Biden’s judgment as a politician and parent—all of which Giuliani has done—are most decidedly not,” The Beast explained.

The Beast spoke to a senior Trump campaign official.

“Leave the crack and sex stuff to Rudy,” the official said.

“Rudy is going to do his thing and there’s nothing we can do about it,” a source close to Trump explained.

Brendan Buck, a former top GOP congressional aide, went on record.

“This is a guy who almost single-handedly got the president of the United States impeached,” Buck said. “He seems to live entirely in a fever swamp with no conception of how much damage he does to the president. It may well please hardcore Trump voters, but it continues to damage the demographics where the president has been hemorrhaging support. It’s also a hell of a gift to Biden to remind average people that he’s a loving father.”

On Wednesday, The Daily Beast reported that Rudy Giuliani is denying any inappropriate conduct was occurring in his cameo appearance in the Borat sequel where he had his hands down his pants in the presence of an actress posing as a reporter.

Instead, Giuliani insisted in a radio interview with WABC, he was merely tucking in his shirt.

“I had to take off the electronic equipment,” said Giuliani. “And when the electronic equipment came off, some of it was in the back and my shirt came a little out, although my clothes were entirely on. I leaned back, and I tucked my shirt in, and at that point, at that point, they have this picture they take which looks doctored, but in any event, I’m tucking my shirt in. I assure you that’s all I was doing.”

“In the scene from the film, which Giuliani likely hasn’t seen yet, he can be seen patting the actress’ backside as she helps him take his microphone off,” wrote Matt Wilstein for The Beast. “He lies down on the hotel room bed and sticks his hands into his pants to tuck in his shirt, but they remain there longer than he is suggesting in his interview. The movie will be released on Amazon Prime Video this Friday.”

The comedy has generated many headlines (as well as mocking tweets and memes) for a scene with Giuliani, the former mayor of New York City and President Donald Trump’s personal lawyer. The plot of the film has Borat and his daughter (played by Bakalova) seeking to curry favor with the Trump administration, including attempting to marry the girl off to a Trump insider.The controversial scene involves her posing as a journalist, and getting Giuliani to meet her in a hotel suite for an interview.

The interview concludes and she invites Giuliani to the bedroom for a drink. Hidden cameras capture him patting her on the hip, and lying back on the bed and putting his hands down his pants, when Borat bursts into the room.

Giuliani slammed the video as a “complete fabrication,” insisted he did nothing “inappropriate,” and was just tucking in his shirt — a defense that Twitter found very laughable — and the whole escapade has created a massive promotional buzz for the movie.

Bakalova’s character is supposed to be 15 years old, but the actress is actually 24, so most likely Giuliani was not doing anything criminal, but the whole thing is truly cringe-inducing to watch — as GMA host Amy Robach commented, “it’s not morning TV friendly.”

Cohen shrugged off Giuliani’s defense of his behavior, telling Robach, “If the president’s lawyer found what he did there appropriate behavior, then heaven knows what he’s done with other female journalists in hotel rooms.”

“I just urge everyone to watch the movie. It is what it is. He did what he did,” Cohen added as Bakalova, seated next to him, chuckled. “And make your own mind up…it was pretty clear to us.”

Bakalova expressed her gratitude to Cohen for interrupting whatever it was that might have happened in that room with Giuliani. “I want to thank you, that I was sure you were going to save me from everything.”

Cohen explained that he was “quite concerned for you during the scene,” but was able to monitor the action the entire time from a hideaway structure nearby, and took his responsibility for her safety very seriously, as the film’s producer.

“I’ve always felt safe with our team, with our crew, with Sacha in my corner,” said Bakalova. “I actually never felt that I’ve been in danger. That’s why I’m lucky, because I had them.”

Cohen and Bakalova also shared some behind-the-scenes secrets from the film, including how they pulled off crashing Vice President Mike Pence’s CPAC speech, and Bakalova’s audition process.

‘Rudy is just a moron’: Ex-Trump lawyer Cohen drops the mic on Giuliani’s very bad week

Appearing on MSNBC with host Maria Teresa Kumar, former Donald Trump fixer Michael Cohen was asked what ex-New York City Mayor Rudy Giuliani is doing for Donald Trump’s re-election bid, with the former Trump lawyer brutally dismissing Giuliani as both a “liability” and a “moron.”

In a week that saw Giuliani’s attempt to smear Democratic presidential nominee Joe Biden fall apart before moving on to a cameo appearance in a Borat film that caught him in a compromising position with an actress playing a teen reporter, Cohen laughed at the week’s events.

“As far as I’m concerned, Rudy is an absolute joke,” Cohen began. “A who was once America’s mayor is now the laughingstock of not just the country but of the whole world.”

“I mean, to get played like that, he is a liability to the campaign, he’s a liability to Donald Trump, he’s a liability to the United States of America,” he continued. “The man is easily capable of being bought. I’ve said this before, he drinks too much and when you drink too much, especially if you are going to get yourself involved into that world, they realize that you have a weakness and they will jump right on that weakness and that is why Rudy Giuliani will get caught with his pants open laying down on bed for a Borat movie.”

“I mean, he’s a moron,” he added with a smirk. “There’s no other way to describe it, Rudy is just a moron.”

Michael Avenatti trial over Stormy Daniels book earnings set for April
Prosecutors allege Avenatti embezzled funds the adult film actress earned from her memoir 'Full Disclosure'

Disgraced lawyer Michael Avenatti is scheduled to go to trial April 26 for allegedly stealing $300,000 from former client Stormy Daniels and forging her signature.

The date for the approximately two-week trial was set during a telephone hearing Tuesday in Manhattan federal court.

Prosecutors allege that Avenatti embezzled funds that the adult film actress earned from her memoir “Full Disclosure,” which includes passages about her alleged pre-White House affair with President Trump.

In a spectacular fall from grace, the former CNN pundit was convicted in February by a Manhattan federal jury of trying to extort nearly $25 million from Nike and is awaiting sentencing in the case.

Avenatti faces two separate California trials, one starting Feb. 23 and a second likely to begin in October, for allegedly stealing from other clients and committing bank and tax fraud.
He has been riding out the pandemic in home detention in Venice, Calif., after he was sprung from federal lockup over fears he could contract COVID-19 while in custody.

He has denied all the charges against him.
